WITNESSETH, that thc party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of thc second part, doe.s hereby grant and release unto the party
of the second pan, the heirs or successors and assigns oftbe party of tile second pan forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being at Southold, Town of Southold, County of Suffolk and State of New
York, s.hown and designated as Lot No. 14, on a certain map entitled "Map of Yennecott Park
situate at Southold. Suffolk County. New York, surveyed by Van Tuyle and Son, Greenport,
New York, May 1, 1968, and £ded in the offiee of the Clerk of the County of Suflbll~ on the
9m day of October, 1958. as Map No. 5187.
SUBJECT lo covenants and restrictions recorded in the Suffolk County Clerk's Office on thc
10u' day of October, 1968, in Liber 6435 at page 221.
TOGETHER with.an ease.re, ent 9[.right of way for all legal purpos, es over thc adjoining streets
to the nearest public higli~ay: but the title to said streets is not hereby conveyed, Donald E.
Tuthill and Lbrna E. Tuthill having reserved the fee to said streets for the purpose of
dedication of the same to the proper municipality.
BEING AND INTENDED TO BE the same premises conveyed to thc party of the Iirst part by
deed dated 11~9/68, and recorded in the Suffolk County Clerk's Office on 12/4/68 in Lih.'r
6467, page 144.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting thc above described premises to thc center lines thereof; TOGETHER
with thc appurtenances and all the eslatc and rights or thc party of thc first pan in and to said
premises; TO HAVE AND TO HOLD the premiss herein granted umo the party of'thc second
pan, the heirs or successors and assigns of the party of the second part rorever.
AND thc party of the first part covenants that the party of the first pan has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of thc Lien Law, covenants that
the party of the first pan will receive thc consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying thc
cost of the improvement and will apply thc same first to the payment of thc cost of thc
improvement before using any part ofthc total of the same for any other purpose.
The word "party" shall be construed as if it read "panics" whenever the sense ot'this indenture so
requires.
