party of the first pan, and
MELINDA VITALE. residing at 2570 Main Road, Laurel, New York 11948,
party of the second part,
WITNESSETH. that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and zelease unto the paw] of
the second pan, the heirs or successors and assigns of the paw] of the second pan forever, a 1%
interest in and to
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, shown and designated as ~)t No. 38 on a certain map entitled "Map of Yennecott Park
situate at Southold. Suffolk County, New York," surveyed by Van Tuyl & Son, Greenport,
New York, May 1, 1968 and filed in the Office of the Clerk of the County of Suffolk on the 9*
day of October. 1968 as Map No. 5187.
BEING AND INTENDED TO BE the same pre'raises conveyed to the party of the first pa~t by
deed dated December 21, 1983. and recorded on January 26, 1984. in the Office of the Suffolk
County Clerk in Liber 9502, Page 210.
TOGETHER with all right, title and interest, if any, of the patty of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
p~cmises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part. the heirs or successors and assigns of the paw] of the second part forever.
AND the party of the first part covenants that the party of the first pan has not done or suffep:d
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the pa~y of the first part. in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the unprovement and will apply the same first to thi: payment of the cost of the improvement
before .using ahy part of thc total of the same for any other purpose.
The word 'party" shall be construed as if it mad 'panics' whenever the sense of this indenture so
~tuires.
