THIS INDENTURE, made the / day of July, Two Thousand One
BETWEEN
LOUISE S. HARWOOD TRUST, by Thomas J. Harwood, Jr., as Trustee under Trust dated
12/15/92, residing at 1305 Cherry Street, Pottstown, PA 19464,
party of the first part, and
ZOUMAS CONTRACTING CORP., whose address is 32 Josephine Drive, Wading River, New
York 11792,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being at Southold,
Town of Southold, County of Suffolk and State of New York, known and designated as Lot
No. 37 as shown on a certain map entitled, "Map of Yennecott Park" and filed in the Suffolk
County Clerk's Office on 10/9/68 as Map No. 5187, and being more particularly bounded and
described as follows:
BEGINNING at a point on the northerly side of Yeunecott Drive, distant 137.00 feet westerly
from its intersection with the westerly side of Laurel Avenue;
RUNNING THENCE South 75 degrees 56' 00" West, along the northerly side of Yennecott
Drive, 148.00 feet;
THENCE North 15 degrees 41' 10" West, 131.00 feet;
THENCE North 65 degrees 05' 30" East, 154.42 feet;
THENCE South 14 degrees 04' 00' East, 160.00 feet to the northerly side of Yennecott Drive
at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first party
by deed, dated March 20, 1993, and recorded May 3, 1993, in the Office of the Clerk of the
County of Suffolk in Liber 11627, Page 610.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
