THIS INDENTURE, made the 29th day of November, Two Thousand Six
BETWEEN
PETER J. DONOHUE and JANICE C. DONOHUE, his wife. residing at 28 Caleb's Way,
Grcenport, New York I 1944
party of the first part. and
ANN MURPHY PHILLIPS, residing at 525 Deerfoot Path, Cutchogue. New York 11935,
party of the second part.
WITNESSETH, that the party of the first pan, in consideration often Dollars and other valuable
consideration paid by the party, of the ~cond part, does hereby grant and release unto the party of
the second part, the heirs or successors a.~.d assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and hnprovements thereon
erected, situate, lying and being Grcunpon. Town of Southold, County of Suffolk and State of
New York. which said lot is more particularly bounded and described as follows:
The unit known as Unit No. 28 (hereinafter called "the Unit") in the building designated as (E)
(hereinafter called the "Building") in the Declaration establishing Pheasant Run Estates
~,X to~o Condominium Ill (hereinafter called th~ "Condominium Property"). made by Moores lane
~r~,.~q0m Holding Corp. under the Condominium Act of the State of New York (Article 9B of the Real
thX~,m.~o Property Law nf the State of New York). recorded in Liber 11720. cp 628. as amended in
L.ot oz~,o Liber 1178, cp 167. and 11843. cp 638 (herfeinafter called the "Declaration). Conduminium
Map No. 257A.
TOGETHER with the benefits, rights, privileges, easements and subject to the burdens,
covenants, restrictions, by-laws, rules, regulations and easements, all as set forth in the
condominium documents filed and recorded as aforesaid;
TOGETHER with an undivided five (5%) percent interest appurtenant to the Unit in the
common elements of the Condominium Property (hereinafter called the ~Common Elements").
The land area of the condominium property is described as follows:
BEGINNING at a point on the easterly side of Moores Lane the point being the terminus of a
curve which connects the northerly line of Cedarfields Drive with the easterly line of Moores
Lane;
RUNNING THENCE from the point and place of beginning along the easterly line of Moorcs
Lane, North 17 degrees 1:5 minutes 00 seconds West, a distance of 498.15 feet to a point:
THENCE North 72 degrees 45 minutes 00 seconds East, a distance of 382.58 feet to a point;
THENCE South 41 degrees 59 minutes 36 seconds East, a distance of 229.47 feet to a point;
THENCE South 75 degrees 01 minutes 50 seconds East. a distance of 340.00 feet to a point
and the westerly line of "Map of Cedarfields" filed in the Office of the Suffolk County Clerk
as Map No. 8966;
THENCE along the westerly line of aforementioned filed map, South 16 degrees 0! minute 50
seconds East, a distance of 136.00 feet to a point on the northerly line of Cedarfields Drive;
THENCE along the northerly line of Cedasfields Drive, South 58 degrees 15 minutes 00
seconds West, a distance of 32.98 feet to a point and the beginning of a curve to the right;
THENCE along the curve to the right having a radius of 689.69 fl.-et a distance of 198.62 fee~;
THENCE South 74 degrees 45 minutes 00 seconds West, a distance of 496.39 feet to a point
and the beginning of a curve to the right which connects the northerly line of Cedarfieids Drive
with the easterly line of Montes Lane;
THENCE along the curve to the right having a radius of 40.00 feet a distance of 61.44 feet to
thc point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to party of the first part by
deed dated June 5, 1998 and recorded June 30, 1998 in the Office of thc Suffolk County Clerk
in Libcr 11901, Page 932, as corrected by deed dated May 5, 2004 and June 15, 2004 in the
Office nf the Suffolk County Clerk in Liber 12425, Page 28.
TOGETHER with all right, title and inte~st, if any. of the party of the first part in and to any
street.~ and roads abutting the above de~ribed premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premiss; TO HAVE AND TO HOI.D the premises herein granted unto the pan'y of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenams that the party of the first part has not done or suffered
anything whereby the said premises have been encumbc~-d in any way whatever, except as
aforesaid.
AND thc parly of the first part, in compliance with Section 13 of the Lien Law, covenanl.~ that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
belbre using any part of the total of the stone for any other purpose.
