THIS INDENTURE, made the [ ~ day of October, 2003 BETWEEN
KATHLEEN M. TOLE, residing at 750 Pipes Neck Road, Greenporl, New York, 11944
party of the first part,
KATHLEEN M. TOLE and MARY ANN DURKIN, both residing at 750 Pipes Neck Road,
Greenport, New York, 11944, as joint owners with the right of survivorship
party of the second part,
WITNESSETH, that the party of the first pan, in consideration ofTEN ($10.00) dollars,
lax~l money of the United States paid by the party of the second part, does hereby grant and release unto
the party of thc second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Greenport, Town of Southold, County of Suffolk and State of New York, being
known and designated as Unit No. 36 as shown and laid out on a certain map entitled, "Map of
Mooresland," filed in the Office of the Clerk of the Count), of Suffolk on December 22, 1994, as
Condominium Map No. 257; "Amended Map of Mooresland a/k/a Pheasant Run Estates", filed in the
Office of the Clerk of the County. of Suffolk on June 13, 1996 as Amended Map No. 257A. together with a
5% interest in common elements of the Condominium described in the Declaration of Condominium
recorded in Liber 11894 page 534.
BEING AND INTENDED TO BE the same premises conveyed to the part)' of the first part by deed
dated March 16, 2001 recorded in the Office of the Clerk of the Count)' of Suffolk on March 28, 2001
in Liber 12110 page 384.
TOGETHER With all right, title and interest, if any, of thc party of the first part in and to any stax'ts and
roads abutting ~.he above described premises to the center lines thereof.
TOGETHER with thc appurtenances and all thc cs[ate and rights oflhe party of the first part in and to said
premises.
'FO [lAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of lhe second part forever.
AND the part)' of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part. in compliance with Section 13 of the Lien Law, covenants that Ihe part),
of the first pan will receive the consideration for this conveyance and will hold thc right to receive such
consideration as a trust fund to be applied first for thc purpose of paying the cost of the improvement, and
will apply the same firs[ to Ihe payment of the cost of the improvement before using any part of the total of
the samE tbr any other purpose. Thc word "part?' shall b~ construed as if it read "parties" whenever thc
sens~ ol'this indenture so requires.
