This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4 sets of plans, accurate plot plan to scale. Fee according to schedule. b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or areas, and waterways. c. The work covered by this application may not be commenced before issuance of Building Permit. d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit shall be kept on the premises available for inspection throughout the work. e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector issues a Certificate of Occupancy. f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an addition six months. Thereafter, a new permit shall be required. Land Lease LEASE made as of this 25th day of February, 2008, between Triberry Fields LLC, a New York limited liability company, having its principal place of business at c/o Bettina Equities LLC, 230 East 85 Street, New York, New York 10028 ("Landlord"), and Frank Perita residing at 19995 Soundview Avenue, Southold, N.Y. 11971, ("Tenant") WITNESSETH: 1. Premises: Landlord hereby leases to Tenant, and Tenant hereby leases from Landlord, for the rent and subject to the provisions of this Lease, that certain parcel of vacant land (the "Premises") described in the annexed Exhibit A and as Lot 10 on the filed map (the "Map"), a copy of which is annexed as Exhibit B. Notwithstanding the foregoing, Tenant acknowledges and agrees that it may not use any portion of the Premises designated as the "Building Area" or the "Turnaround" on the annexed filed map, it being acknowledged that said areas on Exhibit B are more extensive than such areas are designated in the actual filed map. 2. Term: (a) The term (the "Term") of this Lease shall be for ten (10) years, beginning on March 1, 2008 (the "Commencement Date"), and ending on February 28, 2018, (the "Expiration Date"), unless sooner terminated by the Landlord as provided herein. (b) Notwithstanding anything to the contrary contained herein, Landlord has the option (the "Option") of cancelling this Lease for any or no reason, upon ninety (90) days advance written notice to Tenant. In the event that Landlord exercises this option, no rent shall be payable by Tenant to Landlord during the 90 notice period. 3.
