ALI. that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suftblk and State of New York known and designated as follows:
The Condominium Unit (the "Unit") known as Unit No. 59 on "Amended Map of Mooresland" being known as
Pheasant Run Estates Condominium II, said Unit designated and described as Unit No. 59 in the Declaration
establishing a plan of condominium o~vnership of said premises under Article 9-B of the Real Property Law of
the State of New York (the "New York Condominium Act"), dated October 24, 1996 and recorded in the
Suflblk County Clerk's Office on October 24, 1996 in Liber 11798 cp 709 and designated on the Suffolk
County Tax Map as District 1000 Section 040.01 Block 01.00 Lot 059.000 and shown on the Floor Plans of
said condominium, certified by John T. Metzger N.Y.S., L. S. filed in the Office of the Clerk of the County of
Suflblk on June 13, 1996 as Condominium Map No. 257A.
Together ~vith an undivided 5% interest in the common elements.
BEING the same premises described in the deed to the party of the first part herein by deed to the grantor in
LIBER 11849 page 035 recorded in the Office of the Clerk of Suffolk County on August 28, 1997.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all
the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein,
which the party of the first part has or has power to convey or dispose of, whether individually, or by virtue of said
will ,or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consic[eration for this conveyance and will hold the rlght to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
