THE PARTY OF THE FIRST PART HEREBY RESERVE8 A SPECIAL POWER OF
APPOINTMENT, excreisable as often as she may choose, to change her mmaindermen TO or among any
one or more members of a class consisting of the party of the first part's deseondants, in any deg~e,
whether presently living or bom hercad'ter, in such proportions and amounts, without regard to equality,
outright or in trust, as the party of the first part may direct and appoim during her lifetime by properly
written and acknowledged instmment~ and recorded prior to death, making specific reference to this power
of appointmenr.. The party of the first pan may not appoint herself, her estate, her creditors or the creditors
~fher estate, under any circumstances.
IEING AND INTENDED TO BE the same premises conveyed to the patty of the first part by deed dated
November 16, 2004 and recorded in the Office of the Clerk of the County of Suffolk on November 24 in
Liber 12356 at page 913.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
fO HAVE AND TO HOLD thc premises herein granted unto the party ofth~ second part, the heirs or
successors and assigns ofthe party of thc second part forever.
AND the party of the first ~ covenants that the party of the first part ~ not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenant~ that the party
of thc first part will receive the consideration for thi~ conveyance ~ will hold thc right to receive such
consideration as n u'ust fund to be applied first for the purpose of paying thc cost of thc improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
