RUNNING THENCE North 73 degrees 58 minutes 10 seconds East along the mutherly side of
a 50 foot right 9f way, a.~ist,~ce of 218.94 feet to a point in the westerly side of land of
Village of G~enport: '
RUNNING THENCE along land of the Village of Greenport the following two courses and
distances: (1) South 02 degrees 10 minutes 10 seconds West a distance of 305.62 feet to a
point; (2) North 87 degrees 49 minutes 50 seconds West a distance of 129.98 feet to a point in
the easterly side of Middleton Road;
RUNNING THENCE along the easterly side of Middleton Road North 16 degrees 01 minutes
50 seconds West a distance of 249.76 feet tea monument set at the point or place of
BEGINNING.
TOGETHER WITH a non-exclusive right of way over a 50 foot private road from the
northerly corner of the premises herein described westerly a distance of 218.94 feet to
Middleton Road.

thereon erected, situate, lying and being in the Town of Southold, near the Village of
Greenport, County of Suffolk and Stste of New York, bounded and described as follows:=
BEGINNING at the southerly terminus of the easterly linc of proposed 50 foot highway to be
known as Middletun Road, 454.74 feet southerly along said easterly line and its extension
northerly from the extension westerly of the southerly line of Washington Avenue, from said
point of beginning running 'along land now or formerly of thc party of the first part South 16
degrees 01 minutes 50 seconds East, 144.14 feet to land of the Village of Greenport~
THENCE along said land two courses, as follows: (1) North 87 degrees 49 minules 50
seconds West, 176.83 feet; (2) North 16 degrees 01 minute 50 seconds West 88.91 feet to
land of Finno:
THENCE along said land of Finno and across the southerly end of Middleton Road, North 73
degrees 58 minutes 10 seconds l:~t: 167.98 feet to the point of BEGINNING.
It is mutually convenanted that the above-described premises cannot be sold as an individual
building lot and that this shall be a covenant running with the land.

BEGINNING at a monument set on the easterly line of Middlcton Road at the northwesterly
corner of land of Field:
RUNNING THENCE along said easterly line of Middleton Road, North 16 degrees 01 minute
50 seconds West 25.00 feet to land conveyed or to be conveyed to Halsey Staples;
THENCE along said land, North 73 degrees 53 minutes 10 seconds East 227.15 feet;
THENCE al.ong said land, South 02 degrees 10 minutes 10 seconds West, 26.31 feet:
THENCE along said land, South 73 degrees 58 minutes 10 seconds West, 218.94 feet to the
point or place of BEGINNING.
BEING AND INTENDED TO BE the same pmnises conveyed to the party of the first part by
deed from Frank A. Field and Marga~t A. Field dated May 13, 1999, and recorded in the
Suffolk County Clerk's Office on November 29, 1999, in Liber 12003 page 631.
RESERVING, HOWEVER, a legal life estate in the above-descend premises with the
buildings and improvements thereon erected, in and to the party of the first part and Ruth V.
Nelson, his wife.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT. exercisable as ot~'n as he may choose, to change his remainderman as
follows:'
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or bom hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during his lifetime by a properly written and acknowledged instrument, and
recorded prior to death, making specific reference to this power of appointment. The party of
the first part may not appoint himself, his estate, his creditors or the creditors of his estate,
under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereo£; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party oftbe first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 ofthe Lien Law, covenants that
the party of thc firsl part will receive the consideration for Ihls conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose ofpaying the
cost of the improvement and will apply the same first to the payment of the cost of thc
improvement before using any part ofthe total of thc same for any other purpose.
The word "party" shall be construed ns if it read "parties" whenever thc sense of this indenture so
requires.
