Tuthill and others, situate at Laurel, Town of Southold, NY" surveyed March 28, 1928 , by Otto IISTRICT W. Van Tuyl, Greenport, NY, Surveyor, and filed in the office of the 1000 Clerk of the County of Suffolk on the 15th day of January, 1929 , as ;ECTION Map #861 . 126 ,LOCK TOGETHER with all the right, title and interest of the party of the 7 first part in and to Sixth Street adjacent to said premises to the OT center line thereof. 2 TOGETHER with the privilege in common with others to use a right of way Leading from the Boulevard, so called, to Peconic Bay, which said privilege is contained and recited in deed to George I. Tuthill et al , (dated April 17, 1928 and recorded August 13 , 1928 in Suffolk County Clerk ' s Office in Liber 1368 of Deeds, at page 24 . SUBJECT to the following covenant and restriction: That no outside water closet shall be erected or maintained at any time on the remises, which covenant shall run with the land. BEING AND INTENDED TO BE THE same premises conveyed to George .1. Kraebel and Carol M. Kraebel, his wife, by deed dated April 12 , 1957 , from Kaare Dahl, and recorded in the office of the Suffolk County Clerk on April 23 , 1957 in LIber 4290, page 474 . TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.
