ALL that certain plot, piece or parcel of land, with the buildings and improveme~s thereon
erected, situate, lying mid'being in the Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:
BEGINNING at an iron pipe on the easterly side of a proposed 50 foot highway m be known
~ 'Middleton Road", 189.12 feet southerly along said easterly line and its extension northerly
t¥om the extension westerly of the southerly line of Washington Avenue, said point of
I)eginning being the southwesterly corner of land now or formerly of pederson (formerly
Waterhouse) and from said point of begianing; -,
'RUNNING THENCE along said land now ot formerly of Pederson, North 73 degrees 58
minutes 10 seconds East, 115.66 feet m an iron pipe and land now or formerly of Staples
· (formerly of Diaz);
THENCE along said land now or formerly of Staples the following two courses and distances:
1. South' 16 degrees 01 minute 50 seconds East, 110.00 feet;
2. South 73 degrees 58 minutes 10 seconds West, 115.66 feet w said easterly line of said
propo~d 50 foot highway;
THENCE along said easterly line, North 16 degrees 01 minute 50 seconds West, 110.00 feet
to the point or place of BEGINNING.
TOGETHER with a right of way over said proposed 50 font highway to Washington Avenue.
BEING AND INTENDED TO BE the same premises conveyed to the party of thc first part by
deed dated March 22. 1984, and recorded April 5, 1984, in the Office of thc Suffolk County
Clerk in Liher 9540, Page 443.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and fights of the party of the first part in and to said
p~remises; TO HAVE AND TO HOLD the premises herein grained unto the patty of the second
p;m, the heirs or successors and assigns of the party of the second pan forever.
AND the party of the first part covenants that the party of the first pan has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
a~Foresaid.
AND the party of the tint part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the tight
to receive such consideration as a trust fund to he applied first for the purpose of paying the cost
ol' the improvement and will apply the same firs~ to the payment of the cost of the improvement
before tt~ing any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
