MARIE M. STRASSER, Trustee of thc Marie M. Strasser Loving Trust, dated October 4,
1990, residing at 617 West Street, Greenpon, New York 11944,
party ofthe flint part, and
MARIE M. STRASSER, residing at 617 West Street, Greenport, New York 11944, party
of the ~cond part and
PATRICIA R. HALL, residing at 105 Pinehurst Drive, Bradenton, Florida 34210,
party of thc third part,
WITNESSETH, that the party of the first pan, pursuant to the powers granted unto the
party of the first part by a certain trust agreement dated October 4, 1990, and known as
the Marie M. Strasser Loving Trust, does hereby grant and release unto the party of the
second part, a legal life estate in the hereinafter-described premises with the buildings
and improvements thereon erected together with A SPECIAL POWER OF
APPOINTMENT, exercisable as oRen as she may choose, to change the party of the third
pan, hereinafter named, as follows:
TO or among any one or more members ora class consisting of the party of the second
pan's descendants, in any degree, whether presently living or bom hereaRcr, in such
proportions and amounts, without regard to equality, outright or in trust, as thc party of
the second pan may direct and appoint during her lifetime by pmperiy written and
acknowledged instrument, and recorded prior to death, making specific reference to this
power of appointment. The party of thc second pan may not appoint herself, her estate,
her creditom or thc creditors of her estate, under any circumstances.
WITNESSETH, that the party of the first part, pursuant to the powers granted unto the
party of the first part by a certain trust ag~ement dated October 4, 1990, and known as
the Marie M. Strasser Loving Trust, does hereby grant and release unto the party third
part all of the party of the first parts right title and interest, subject to the above
mentioned life estate and special power of appointment .the heirs or successors and
assigns of the party of the second part forever, all that certain plot piece or parcel oI'land
with the buildings and improvements thereon erected more particularly bounded and
described as follows:
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erecled,
situate, lying and being at Greenport, Town of Southold, Suffolk County, New York,
known and designated as Lot Number 57 on a certain map entitled subdivision map, part
of the Estate of Thomas F. Price, Sr., which map is made by Otto W. Van Tuyl, dated
November 29~, 1927, and flied in the office of the Clerk of Suffolk County, New York,
as Map 'No. 851, which Iot'is bounded on the north by West Strect, 50 feet; on the east by
Lot Number 58, 150 feet; on the south by Lot Number 44, 50 t~et and on the west by land
ofthe Union School District Number 10 of Southold Town, 150 feet.
It is understood and agreed that certain streets shown on the above said subdivision map
and known as Oak Street, Maple Street, West S~ect and Seventh Avenue and running to
the property of the Union School District Numbcr 10 on the westerly side of thc said
subdivision map have been closed at the Junction with thc said union School District No.
10 property and they are DEAD END STREETS.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
parl by deed dated 3/11/94, and recorded in the Suffolk County Clerk's Office on
3/11/94, in Liber 11668, Page 054.
The party of thc second part does hereby join in the execution of this dccd to confirm thai
as grantor of the above mentioned trust and sole lifctime beneficiary thereof, she consents
and desires this deed to be executed in those capacities as well as her capacity as the sole
trustee ofsaid trust.
TOGETHER with all fight, title and interest, if any, of the party of the first pan in and to
any streets and roads abutting the above descril~ premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party ofthe
pan in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the first po~ has not done or
suffered anything whereby the said premises have been encumbered in any way
whatever, cxccpt as aforesaid.
AND the party ofthe first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed u if it read "parties" whencvcr thc sense of this
indenture so requires.
