EUGENE MAZZAFERRO, residing at 215 Oak Street, Greenport, New York 11944
party of the first part, and
NANCY SCHMIDT, residing at 8 Maple Lane, Montgomery, New York 12549; and
CHRISTINE L. FOSTER, residing at 820 Gabriella Court, Mattituck, New York 11952
party ofthe second pan,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs 6r successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being in the Village of Greenport, Town of Southold, Suffolk County, New
York, known and designated as part of lot//96 and//97 on a certain map entitled, Subdivision
Map, Part of the Estate of Thomas F. Price, Sr., which map is made by Otto W. Van Tuyl,
dated November 29, 1927, and filed in the Office of the Clerk of Suffolk County, New York,
on 12/12/27, as Map No. 851, said lot and part of lot being bounded and described as
follows:-
BEGINNING at a point on the southerly side of Oak Street where same is intersected by the
division line between Lot #97 and Lot 98 on the above-mentioned map;
THENCE South 14 degrees 46 minutes 40 seconds West along said division map 150.00 feet;
THENCE North 75 degrees 13 minutes 20 seconds West,60.00 feet;
THENCE North i4 degrees 46 minutes 40 seconds East, 150.00 feet to the southerly side of
Oak Street;
THENCE South 75 degrees 13 minutes 20 seconds East along the southerly side of Oak Street,
60.00 feet to the point or place of BEGINNING.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as he may choose, to change his remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during their lifetime by a properly written and acknowledged instrument,
and recorded prior to death, making specific reference to this power of appointment. The
party of the first part may not appoint themselves, their estates, their creditors or the creditors
of their estate, under any circumstances.
TillS DEED IS AN EXERCISE OF THE SPECIAL POWER OF APPOINTMENT
contained in a certain prior deed in respect to the above-described premises dated March
23, 1999, recorded in the Suffolk County Clerk's Office on March 31, 1999, in Liber 11954
page 440; and it is further stated that the party of the first part continues to reserve a
special power of appointment as hereinabove set forth.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and ~all the estate rind rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
