party of the first part, and
STEVEN N. GARMS and CHRISTINE A. GARMS, husband and Wife, both residing at 4377
Sound Avenue, Riverhead, New York 11901
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being in the Town of
Southold, County of Suffolk and State of New York, more particularly bounded and described '
as follows:-
BEGINNING at a point on the easterly side of Rene's Drive (Private Road) which point is
300.84 feet southerly from the intersection formed by the easterly side of Rene's Drive with
the southeasterly side of Soundview Avenue, said point being the southerly point of land now
or formerly of Macchiarolli;
RUNNING THENCE from said point of beginning North 47 degrees 08 minutes 10 seconds
East, 120.00 feet to a point and land now or formerly of Hahn;
THENCE along land now or formerly of Hahn, South 42 degrees 51 minutes 50 seconds East,
455.06 feet to Rene's Drive;
THENCE along Rene's Drive the following five (5) courses and distances:
(1) South 47 degrees 08 minutes 10 seconds West, 35.00 feet to a point;
(2) North 42 degrees 51 minutes 50 seconds West, 55.00 feet;
(3) Along the arc of a curve bearing to the left having a radius of 200.00 feet a distance of
168.21 feet; ~
(4) Along the arc of a curve bearing to the right having a radius of 55.00 feet a distance of
46.26 feet;
(5) North 42 degrees 51 minutes 50 seconds West, 210.00 feet to the point or place of
BEGINNING.
TOGETHER WITH the right to use Rene's Drive, as shown on Map of Minor Subdivision of
Indian Woods at Southold, N.Y., for the purposes of ingress and egress to and from the
subject premises to and from Sound View Avenue and together with a twenty-five (25%)
percent fee title interest to said Rene's Drive.
SUBJECT TO the rights of the owners of Lots 2 and 4, as designated on Map of Minor
Subdivision of Indian Woods at Southold, N.Y., to pass and re-pass over a certain portion of
the above described property for the purposes of ingress and egress to and from said Lots 2
and 4 to and from Sound View Avenue, said portion of Lot 3 being more particularly bounded
and described as follows:-
BEGINNING at a point on the southeasterly side of Sound View Avenue said point 320 feet
from the intersection of said southeasterly line of Sound View Avenue and the northwesterly
line of Hickory Road on a course of North 36 degrees 52 minutes 10 seconds East and running
thence the following two (2) courses and distances: (1) South 47 degrees 56 minutes 10
seconds East, 200.84 feet; (2) South 42 degrees 51 minutes 50 seconds East, 222.50 feet to
the true point of beginning;
RUNNING THENCE from said true point of beginning South 42 degrees 51 minutes 50
seconds East, 87.50 feet;
RUNNING THENCE along a curve to the left having a radius of 55 feet and a length of 46.26
feet;
RUNNING THENCE along a curve to the right having a radius of 200 feet and a length of
35.57 feet;
RUNNING THENCE North 58 degrees 17 minutes 10 seconds West, 160.21 feet to the true
point of BEGINNING.
BEING AND INTENDED TO BE part of the same premises conveyed to the party of the first
part by deed dated 12/30/99 and recorded in the Suffolk County Clerk's Office on 1/26/00 in
Liber 12016 page 116. ,~
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
