party of the first part, and
THE CATHERINE LINDTVEIT LIVING TRUST, whose address is 648 Route 10 West, Apt.
228, Randolph, New Jersey 07869,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Bayview in the Town of Southold, County of Suffolk, and
State of New York, bounded and described as follows:
BEGINNING at a monument on the southeasterly line of a 16.5 foot right-of-way at the northerly
comer of land conveyed to Rita Pascua and the westerly comer of other land now or formerly of
Henry C. Bunce and Gertrude Bunce; from said point of beginning;
RUNNING along said southeasterly line, North 46 degrees 38 minutes 50 seconds East, 65.0 feet
to a monument;
THENCE along land of Koke, South 18 degrees 30 minutes 00 seconds East, 143 feet to ordinary
high water mark of Corey's Creek;
THENCE along the ordinary high water mark of Corey's Creek, along a tie line bearing South 28
degrees 14 minutes 20 seconds West, 63.97 feet to land of Rita Pascua;
THENCE along said land, North 22 degrees 56 minutes 10 seconds West, 160 feet to the point of
BEGINNING.
TOGETHER with right-of-way 16.5 feet in width, the easterly and southerly lines of which are
described as follows:
BEGINNING on the westerly comer of the premises hereinabove described and running North
46 degrees 38 minutes 50 seconds East, 162.0 feet;
THENCE South 64 degrees 43 minutes 50 seconds East, 119.32 feet;
THENCE South 86 degrees 30 minutes 00 seconds East, 50.0 feet;
THENCE North 25 degrees 16 minutes 10 seconds East, 459.86 feet to the southerly line of
Bayview Road.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated April 1, 1969, and recorded April 4, 1969, in the Office of the Suffolk County Clerk
in Liber 6529, Page 506.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
