After re"iew of the written resolution for the Tru.'itees Permit of Julie Ann. Haerr, we noticed that the description
incorrectly states the intended material for the rear deck. Our intentions were to remove the existing concrete patio and
place a new wood deck over the eximng footprint. The actual me of the deck would be 5ix feet larger in the ea.~ly
direction to tie into the proposed addition, We are 'writing 1:0 you for a clarification if the Te.'IOlution would need to be
reworded or would a simple acknowledgement Jetter from your Board be adequate for the fmal inspection. We do not
want there to be any confusion during the construction process of this project. Let me know how you wish to bandJe

Dear Mr. Stromski:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 15, 2006 regarding the above matter:
WHEREAS, Searles, Stromski, Associates as agent for JULIE ANNE HAERR applied
to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated December 30, 2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 15, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
South old Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of JULIE ANNE
HAERR to construct first and second floor additions to the existing dwelling, two-car attached
garage, and concrete patio, with the conditions that a haybale line be placed 15' seaward of the
patio, gutters and drywells to contain roof runoff, and the vegetated buffer along the shoreline
be maintained with no turf, and all as depicted on the plan drawn by Searles, Stromski,
Associates last dated 1/06 and stamped by the Trustees on 2/15/06.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

To the Board of Trustees, Town of Southold:
My name is Patricia Jaeger and I reside at 420 Mill Creek Dr. in
southold, diagonally across the street from the residence in question.
Mill Colony is plagued by flooding and water collecting and sitting for
extended periods of time, in moderate rainfall and snow.
Any rain or snow above moderate is a flooding disaster due to
practically non existing drains.
There is a drain in front of 260 Mill Creek Dr., directly across the
street from, the property in question.
However, this drain is nOD- functioning despite requests from the
owner of 260 Mill Creek Drive, Christine Popovich, to the town of
Southold, to come and clear the drain.
The next drain is opposite,
stop the water from flooding
and 260 Mill Creek Dr.
540 Mill Creek Dr., which does nothing to
in from of my home, 420 Mill Creek Dr.
My concern is that any new precedents being established will add to
existing problem which becomes worst daily.
It is necessary for me to go out of state and I regret I can't be
present at the hearing. I thank you for giving me this opportunity to
share my concerns with you all.

This letter is to serve as our formal correction of information that was incorrectly stated in the
original application, The application has conflicting information with regard to the amount of
material to be excavated during the course of construction. It was listed as 657 cubic yards in one
location and then 65 cubic yards in another. The correct amount of cubic yards of material to be
excavated due to a new crawl space under the new addition and the attached garage foundation
totals 780 cubic feet or 28,8 cubic yards of material. TIris material would be regarded around the

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards, Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records gyailable to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards
and therefore is INCONSISTENT with the LWRP.
Policy 6
Protect and restore the quality and function of the Town of South old
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southo/d Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions,
The proposed setback from the wetland system is 60.3 (proposed patio enlan!ement) feet; a
minimum separation distance of 100' is required pursuant to Chapter 97. Please require
that the applicant amend the application to meet the above policy to the l!reatest extent
possible,

Additionallv, ifthe action is approved and to further Policv 5: Protect and Improve Water
Ouality iu the Town of South old.
1. Require erosiou and sediment controls (havbales, silt fenciue) to protect the
wetland svstem to the north of the property.
2. Require native disease-resistant and droueht-tolerant landscapine to minimize
irrieation and fertilizer applications.
3. Require eutters. downspouts and sub-surface drvwells to control stormwater
runoff.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written detennination regarding the consistency of the proposed action.
