The meeting began at 7:15 p.m. with five LPC members present. Adoption of Meeting Minutes: ?? Acceptance of meeting minutes from October 14, 2008 MOTION made by Eric Keil, seconded by Monica Harbes, to adopt the October 14, 2008 meeting minutes as revised. Motion carried: 5/0 Applications and Inquiries: ?? C.W. FRANCIS & SON, INC. PROPERTY (Orient Reserve) SCTM #: 1000-19-1-14.7 Zoned: R-80/R-200 Location: 32400 Rt 25, Orient CPF: Yes Total Acreage: 26.5 acres (GIS 26.8 acres) Subdividable: Yes PDR application. Update re: meeting with Melissa Spiro had with landowner regarding offer [executive session – offer status subject of discussion] At the October 14, 2008 Land Preservation Committee meeting, the Committee passed a motion to offer to purchase an easement for purposes of farmland protection and scenic protection for a 1 building envelope proposal as follows: 3 acre reserve area at the north end of the property; agricultural structures restricted to the area within the R-80 zoning district and limited to 2% lot coverage; and a Covenant and Restriction on the 3 acre reserve area prohibiting subdivision of the 3 acre building envelope from the preserve farm area. Melissa made offer to landowner and landowner asked for Covenant and Restriction requirement to be removed. LPC discussed pros and cons of removing C&R and suggested the need for general policy review for restrictions on size of residential dwelling within PDR Reserve Areas in order to increase the potential for farmland to remain as active farmland. LPC determined that for this application, since policy was not discussed, finalized or presented to Town Board, that requirement would be removed. MOTION made by John Sepenoski, seconded by Chris Baiz, to revise the offer made at the10/14/08 Committee meeting by eliminating the requirement for a Covenant and Restriction on the 3 acre reserve area prohibiting subdivision of the 3 acre building envelope from the preserved farm area. All other terms of the 10/14/08 offer to remain the same. Motion carried: 4/1 (Ray Huntington) It was noted that Ray Huntington was not opposed to the eliminating the requirement for a Covenant and Restriction; however, he had voted “no” to the original offer. Melissa was directed to present recommendation for purchase to the Town Board before proceeding further. ?? KOPPELMAN PROPERTY SCTM #: 1000-31-7-7 Zoned: R-40 Location: 8740 Rt 25, East Marion CPF: Yes Total Acreage: 6.43 acres Subdividable: Yes Open Space Application Update re: Town Board Executive Session [executive session]. Melissa gave update from Town Board executive session. Randy Parsons gave status update re: potential County application. Landowners likely to request County acquisition. LPC decided that it would be appropriate for Randy Parsons, under TNC contract, to facilitate project before County. LPC noted that if County asks for Town partnership, at that point in time, LPC and Town Board will review and make determination re: potential partnership. Randy Parsons gave status of adjacent property (Manfredi SCTM #1000-31-7-20). Landowner has submitted letter of interest. Randy will forward to County. As with Koppelman, LPC noted that if County asks for Town partnership, at that point in time, LPC and Town Board will review and make determination re: potential partnership. ?? Previously TNC to pre-acquire property with re-sale to Town/County (50/50 partnership) of open space after house lot subdivided from open space. Due to time passing, new appraisals were prepared by County and County is in position to make new offer for County/Town partnership. MOTION made by John Sepenoski, seconded by Eric Keil, to proceed with offer for 50/50 Town/County acquisition of the open space after lot subdivided from open space, provided that lot design allows for adequate access and parking area within the open space parcel. Motion carried: 5/0 LPC to meet with Town Board to discuss project. END OF EXECUTIVE SESSION ?? PEKUNKA PROPERTY SCTM #: 1000-53-1-6.1 Zoned: LI Location: 475 Pipes Neck Rd, Greenport CPF: Yes Total Acreage: 11.61 acres Subdividable: Yes Fwet: 7.63 ac Open Space Application (Holdover from 10/14/08 LPC meeting) Discussed additional information from landowner. Randy Parsons went over his meetings/discussions with landowners and attorney for landowners. Randy has received letter of interest from all landowners. Landowners likely to request County acquisition. LPC decided that it would be appropriate for Randy Parson, under TNC contract, to facilitate project before County. Melissa went over Staff report for new PDR application. Melissa noted that SCWA owns adjacent property and SCWA may be interested in acquisition of part of the property. LPC concerned re: potential SCWA ownership and SCWA ownership does not always guarantee perpetual preservation of the property. Property is not currently in active agriculture. MOTION made by Eric Keil, seconded by John Sepenoski, to direct Melissa Spiro to commission an appraisal of the Venetis property for the purchase of a development rights easement. Motion carried: 4/1 (Ray Huntington) It was noted that Ray Huntington would prefer exploration of SCWA purchase potential. ?? VITTI PROPERTY SCTM #: (farm) 1000-59-3-27 Zoned: A-C Location: 43155 CR 48, Southold CPF: Yes Total Acreage: 20.76 acres (GIS 20.98 acres) Subdividable: Yes Status update. LPC reviewed inquiry from Planning Board as to layout LPC would support. Preservation application is before County Farmland Committee and County is not supporting the area shown for preservation in the Conversation Layout design currently before Planning Board. LPC does not support lots or building envelopes designed on the south side (CR 48 road frontage side) of the property. LPC prefers design with least amount of lots possible located within the far northeast side of the property. ?? Eric Keil left the room and recused himself from any discussions on this project due to his personal interest in the property. LPC started appraisal review but held off until Melissa and landowner could meet and review proposed Reserve Area with Planning. ?? P&E, LLC (Peter Harbes) PROPERTY SCTM #: 1000-120-3-11.11 PDR Acreage: ±17 acres Location: 5655 Aldrich Lane, Mattituck Zoned: A-C Total Acreage: ±22.166 acres Subdividable: Yes CPF: Yes PDR application Reviewed new application received on 10/8/08. Monica Harbes left the room and recused herself from any discussions on this project due to a family connection. Melissa went over new PDR application with Committee and Staff report. Landowner is requesting 2-3 residential lots as part of Conservation Subdivision. Landowner has not yet reviewed Conservation Subdivision with Planning Board. Melissa has scheduled field inspection with Planning Staff. LPC discussed potential location for the 2-3 proposed lots and is generally favorable to locating lot along Aldrich Lane. LPC discussed restrictions on future agricultural structures and decided that they were not necessary on this application for scenic purposes. MOTION made by John Sepenoski, seconded by Chris Baiz, to direct Melissa Spiro to commission an appraisal for a development rights easement on property owned by Peter Harbes (P&E, LLC). Motion carried: 5/0 ?? BIGGANE PROPERTY SCTM #: 1000-95-1-11.2 PDR Acreage: ±17.7acres Location: 8865 Oregon Rd, Cutchogue Zoned: A-C Total Acreage: ± 19.7 Subdividable: Yes CPF: Yes PDR application Reviewed new application received on 10/14/08. Melissa went over new PDR application with Committee. Landowner is requesting 1 residential lot as part of Conservation Subdivision. Landowner has not yet reviewed Conservation Subdivision with Planning Board. Melissa has scheduled field inspection with Planning Staff. LPC discussed potential location for proposed lot and is generally favorable to locating lot along the north side of property. LPC discussed restrictions on future agricultural structures and decided that for scenic purposes agricultural structures to be restricted to 2% lot coverage. MOTION made by Ray Huntington, seconded by Monica Harbes, to direct Melissa Spiro to commission an appraisal on the Biggane property for the purpose of a development rights easement. Value to include restriction limiting future agricultural structures to 2% of easement area. Motion carried: 5/0 General Items: ?? DEER MANAGEMENT PROGRAM PROPOSAL Town’s proposed Deer Management Proposal and proposed Properties were discussed. Questions were raised as to hunting/trail potential conflicts and how program was going to be managed and administered. Al Krupski asked whether or not Committee was in favor of hunting on Town owned open space properties. Committee is in favor of allowing hunting on Town owned open space properties. rd ??
