Dear Mr. & Mrs. Wieczorek:
We have completed our review of Application Number 1999-
12970-L2.
Pursuant to Section 10 of the Rivers and Harbors Act of 1899
(33 USC 403), you are hereby authorized by the Secretary of the
Army:
ACTIVITY:
To construct a 4 foot by 42 foot fixed pier,
elevated a minimum of four feet above the grade of
the marsh, a 3 foot by 20 foot hinged walk-ramp
and a 6 foot by 30 foot float secured to two
2-pile dolphins. All work shall be performed in
accordance with the attached drawings which are
hereby made part of this permit.
WATERWAY:
an unnamed lagoon off Shelter Island Sound
LOCATION:
Town of Southold, Suffolk County, New York
The activity authorized herein must be completed within
three years of the date of this permit. This authorization is
subject to the enclosed conditions. Please find enclosed two
forms to be used to submit to this office, as required, the dates
of commencement and completion for the authorized activity. Also
enclosed for your information is a Notification of Applicant
Options.
The authorized activity must be performed in accordance with
the enclosed plans. If any material changes in the location or
plans of the subject work are found necessary, revised plans
should be submitted to the District Engineer. These plans must
receive the approval required by law before work begins.
Notice is hereby given that the permittees should recognize
that a possibility exists that the structures permitted herein
may be subject to wavewash from passing vessels. The issuance of
this permit does not relieve the permittees from taking all
proper steps to insure the integrity of the structures permitted
herein and the safety of boats moored thereto from damage by
wavewash and the permittees shall not hold the United States
liable for any such damage.

Members of the Board:
Please fred attached copies of permits issued by the U.S. Army Corps of Engineers and New
York State Department of Environmental Conservation (DEC) for the proposed dock to be
reviewed again at your upcoming regular meeting of February 24, 2000.
Given the determinations by these agencies that the proposed catwalk, ramp, and 6' x 30' float
will not have significant navigational or environmental impacts at this location, we respectfully
reiterate our request that the Board similarly grant approval for a 30' long float. Although we
recognize the Board's established policy of limiting float length to 20' over publicly owned
bottomlands, the bay bottom over which the subject dock would be constructed is privately
owned by the applicant.
Thus, in the absence of other demonstrable adverse impacts that wouM result fi.om employing a
30' versus 20' float at this location or language in Chapter 97 that would preclude the Board
fiom granting such a float over privately owned bottom, the Board should approve the dock as
proposed.

NOTIFICATION OF OTHER PERMIT'FEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation
of the State of New York, its representatives, employees, agents, and assigns for all claims, suits, actions, damages,
and costs of every name and description, arising out of or resulting from the permittee's undertaking of activities or
operation and maintenance of the facility or facilities authorized by the permit in compliance or non-compliance with the
terms and conditions of the permit.
Item B: Permittee's Contractors to Comply with Permit.
The permittee is responsible for inform ng, jtS ~ependeht contractors, employees, agents and assigns of their
responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect
to the permitted activities, and such persons shall be subject to the same sanctions for v o at ons of the Environmental
Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits

GENERA~.'CONDITIONS
General Condition 1: Facility Inspection b~/'t'heDepar~ment
The permitted site or facility, including relevant records, is Subject to inspection at reasonable hours and intervals
by an authorized representative of the Department ~f Environmental Conservation (the Department) to determine
whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended
pursuant to ECL 71-0301 and SAPA 401(3).
The permittee shall provide a person to ac~:o~pa~/th,~e Department's representative during an inspection to the
permit area when requested by the Department.
A copy of this permit including all referenced ~psl drY,rings and special conditions, must be ava ab e for
inspection by the Department at all times at th~. proje~:t~ s~te'br f~cility. Fa ure to produce a copy of the perm t upo~
request by a Department representative is a vib'afi0n'~f this permit.
General Condition 2: Relationship of thi~'~6i;ifiit'to'~h~fDepartment Orders and Determinations
Unless expressly provided for by the Department, ~ssuance of th~s permit does not modify, supersede or rescind
any order or determination previously issued by th~ 'DepaF~ment or any of the terms, conditions or requirements

1. If future operations by the State of New York r~quire an alteration in the pos t on of the structure or work herein
authorized, or if, in the opinion of the Departn~r~t:0f Ed~/ir~nmental Conservation it shall cause unreasonable
obstrucUon to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people
of the State or cause loss or destruction 0f. th~ 'n~tura r~spurces of the State, the owner may be ordered by the
epartment to remove or alter the structural work obstructions or hazards caused thereby w thout expense to the
State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of
the watercourse hereby authorized shall ngt b.e completed; the owners, shaft, without expense to the State, and to
such extent and in such time and manner a~ ~he. D~epaFtment of Environmental Conservation may require, remove
all or any portion of the uncompleted structure 0r §Il and restore to its former condition the navigable and flood
capacity of the watercourse. No claim shall be made against the State of New 'York on account of any such removal

2. The State of New York shall in no case be liable~for~any damage or injury to the structure or work herein authorized

3. Granting of this permit does not relieve the applicant of the. responsibility of obtaining any other permission, consent
or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services
or local government which may be required.

7. If upon the expiration or revocation of this permit ,the project hereby authorized has not been completed the
applicant shall, without expense to the Stati~',:'ah~'i~ $,",ch:exteht and in such time and manner as the Department
of Environmental Conservation may require~ r~m0¥e all Or ahy portion of the uncompleted structure or fill and restore
the site to its former condition. No claim.shall:'b~ made against the State of New York on account of any such
removal or alteration.
8. If granted under 6NYCRR Part 608, the NYS D'~paftment of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations Or Other limitations or standards under Sections 301,302, 303,
308 and 307 of the Clean Water Act of 19771(PL 95-2.17) provided that all of the conditions listed hereto are met.
9. At least 48 hours prior to commencement o~the project the permittee and contractor shall sign and return the top
portion of the enclosed notification form ce~i~?~ tl~ti~h~Y ~ie fully aware of and understand ail terms and
conditions of this permit. Within 30 days (~{~P ~t o~~ 0f Project the bottom port on of the form must also be

issuance of this permit be construed to suggest that the Department will issue a permit for such activities in the
future.

The following action was taken by the Board of Town Trustees
during its regular meeting held on February 24, ~000 regarding
the above matter:
W~EREAS, En-Consultants, Inc. on behalf of ROBERT WiECZOREK
a~plie~ to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of ~outhold..
application dated November 5, 1999, and,
said Application was referred to the" '
Con~erva'tien Advisory Council for their findings
recommeudations, a~d,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on February 24, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members
familiar with the premises
and,
have personally viewed and are
in question and the surrounding area,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
ROBERT WIECZOREK to construct a fixed timber dock consisting of
a 4'X 12' ramp to a 4'X 42' fixed catwalk, elev. 3 1/2' above
marsh, a 3'X 20' hinged ramp and a 6'X 20' float with a 4'X 4'
extension for ramp to be secured by (2) two-pile dolphins.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two yea£s
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Mr. Krupski;
Tuesday evening I attended a public hearing at the town hall with respect to
applications for permits under the Town wetlands ordinance. Normally I do not attend
such meetings. However fbr a number of years I have been president of the Southold
Shores Association which is the owner of Tarpon Drive and the application of Frank &
Ingeborg Flynn involves property adjacent to Tarpon Drive. The Association did not
receive any notice of this action and therefor I was prepared to object to the hearing. As
it turned out that item was postponed anyway.
I thought that I would write to you and give you a little bit of local history which I
could not do at a public hearing. Most of it you probably already know.
The Map of Southold Shores was filed Aug. 29, 1963 by Harold and Frederick
Reese. At that time I was a civil engineer living in the Town of Brookhaven where no
subdivision map could be filed until the roads were built according to Town
specifications and dedicated to the Town. Unfortunately this was not a requirement in
Southold and the roads here remained the property of the developer who did little to
maintain them. I bought a lot in 1972 because it was on a bulkheaded canal. About 1976
we formed the Southold Shores Association in order to have control over the roads and
also the "park lot" and "beach lot". Finally about 1994 I was able to get the roads, with
the exception of Tarpon Drive, token over by the Town. The main reqmrement under
state law was that lot owners representing over 50 pement of the road frontage had to
sign statements approving of the action. This requirement could not be met with respect
to Tarpon Drive because the Reeses still owned several lots and the owners of three other
lots would not agree. One of those was Frank Flynn.
Shortly after the Flynns arrived Frank appeared at one of our meetings and
announced that he owned half of the road in front of his home and would arrest anyone
who trespassed on that side of the road. When I tried to point out that the road was the
property of the Association he would not listen and thereafter I tried to ignore him.
About 1973 one lot owner placed a small section of floating dock at the end of
Blue Marlin Drive. Some time later other lot owners wished to extend this dock. Some
of the early owners had obtained a sales map from Reese which indicated a boat basin at
the end of Blue Marlin Drive and they were led to believe that the Association owned
such a basin. I pointed out that the deed to the Reeses for the Southold Shores property
was described as bounded by the high water mark and as the "boat basin" was still owned
by Sage no piles could be driven there. Several of the boat owners formed a separate
corporation and obtained a deed to land under the water so they could extend their dock.
I was not involved because I had no need for a dock. At the time Henry Weismann was a
member and immediately he and Flynn obtained a deed from Sage for land under the
water at the end of Tarpon Drive fearing that we might do something there. Both of the
men raised objections to the extension of the dock. This was about the same time that
they were objecting to expansion of the marina owned by Howard Zehner also in Sage
Basin. This went on for a number of years and must have cost Howard thousands of
dollars. Now the Flynns are requesting a permit to build a dock, not for themselves, but
for a party buying their home. Their concerns for pollution by boats and all the other
detrimental effects on ecology cited in the past seem to have suddenly disappeared. In
advertising the sale of their home they have had the audacity to use a photograph of Brick
Cove Marina as one of its attractions..
I am sure thast this application will be approved and we are happy to see the
Flynns moving to another part of the country. The Weismanns left 2 or 3 years ago. So
the neighborhood is slowing improving.
There is much I could tell about our area and would be glad to at any time but I
know that your position as a Town Trustee requires your time in all areas of the Town.

30' float (with a 4'X 4' extension for ramp), to be secured by (2) two-pile (8" diameter)
dolphins. Dock will be constructed over owner's privately-owned underwater pamel,
known as SCTM# 1000-57-1-39.2

Wetland Permit Application of WILLIAM BAYLIS 66-3-1 to construct approx. 91
linear ft. of vinyl low-sill bulkhead and create approx. 930 sq. ft. of intertidal marsh
landward thereof by placing approx. 75 c.y. of clean sand fill to be trucked in from an
upland source and planted with Spartina altemiflora (12" on center) on a 1:7 slope.
Remove existing 10'X 35' fixed timber dock and associated pilings and construct a fixed
timber dock, consisting ora 4'X 28~ fixed catwalk (elevated a minimum of 4' above
proposed marsh grade); a 3'X 14' ramp; and a 6'X 20' float to be secured by (2) 8"
diameter pilings.

Permit from the Board of Trustees to:Construct a fixed timber dock
consisting of a 4' x 12' inclined ramp, leading to a 4' x 42' fixed catwalk
(to be elevated 4' above marsh grade); a 3' x 20' hinged ramp; and a
6' x 30' float (with 4' x 4' extension'for ramp), to be secured by (2)
two-pile (8" diameter) dolphins. Dock will be constructed over owner's
privately owned underwater parcel, known as SCTM #1000-57-1-39.2.
2. That the property which is the subject Environmental Review
is located adjacent to your property and is described as
follows: 835 Tarpon Road, Southold
3. That the property which is subject to Environmental Review
under Chapters 32,37,or 97 of the Town Code is open to public
comment. You may contact the Trustees Office at 765-1892 or in
writing.
The above referenced proposal is under review of the Board of
