HomeMy WebLinkAboutL 12193 P 151 Bare, In and Sale Deed with Covenants against Grantor's Acts, Individual or Corporation (Single Sheet) CONSULT YOUR LAWYER BEFORE SIGNING THIS INSTRUMENT - THIS INSTRUMENT SHOULD BE USED BY LAWYERS ONLY THIS INDENTURE, made the Cday of ~ , Two Thousand and Two Between KlM CHILTON, as Trustee of the DORIS S, SULLIVAN GREENPORT RESIDENCE TRUST dated March 27, 2000, residing at 475 Clearview Avenue, Southold, NY 11971, party of the first part, and KlM CHILTON, residing at 47o venue, ~outhold, NY 11971, JUDITH FRANIK, residing at 820 Beach Road, Greenport, NY 11944, and GLENN SULLIVAN, residing at 2226 Moltansic Avenue, Yorktown, NY as tenants in common, party of the second part, Witnesseth, that the party of the first pad, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in Greenport (partially within the Incorporated Area and partially without), Town of Southold and State of New York, bounded and described as follows: BEGINNING at an iron pipe on the curved southerly side of Beach Road at the intersection thereof of the northwesterly corner of the premises to be described and points northerly corner of land of the Town of Southold; RUNNING THENCE easterly along the southerly side of Beach Road on a curve bearing to the left having a radius of 446 feet a distance along said curve of 100 feet to land now or formerly of Poller; THENCE South 38 degrees 46 minutes 40 seconds West along said land 212.50 feet to the Waters of Sterling Creek; THENCE along same on the tie line course of NoAh 68 degrees 34 minutes 00 seconds West 80.51 feet to the aforementioned lands of the Town of Southold; THENCE North 33 degrees 10 minute,,; 00 seconds East along same 234.0 feet to the southerly side of Beach Road at the point or place of BEGINNING. BEING AND INTENDED TO be the same premises conveyed to the party of the first pad herein by deed dated 3/27/2000, recorded in Liber 12044, cp 092. Together with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises; To Have and to Hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second pad forever. And tile party of the first pad covenants that the party of the first pad has not done or suffered anything whereby the said p]'emises have been encumbered in any way whatever, except as aforesaid. And the party of the first pad, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any pad of the total of the same for any other purpose. The werd "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
