THIS INDENTURE, made the 30th day of November nineteen hundred ninety nine,
BETWEEN CARROLL J. HARVEY, residing at 2200 Wickham Avenue, Mattituck, New York 11952,
as surviving tenant by the entirety under the Last Will and Testament of Stella F. Harvey who died a resident
of Suffolk County on , party of the first part, and
BEVERLY JEANNE BEAKHURST, residing at 36 Kyle Road, Hampton Bays, New York JUDITH A.
HARVEY, residing at 1 Bridgewater Court, Pittsford, New York and CARROLL J. HARVEY, JR., residing at
6399 Patrick Henry Highway, Roseland, Virginia, as tenants in common, party of the second part,
WITNESSETH,that the party of the first part, in consideration of--------TEN AND 00/100-------------------- ------

release unto the party of the second part, the heirs or successors and assigns of the party of the second part

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Mattituck, Town of Southold, County of Suffolk and State of New York, known and
designated as Lot 29 on a certain map entitled, "Mattituck Heights, Subdivision Map Property of Gustav
Bayer, situate at Mattituck, Suffolk County, New York," surveyed February 19, 1927 by Otto W. Van Tuyl,
Licensed Surveyor, Greenport, New York and filed in the Office of the Clerk of the County of Suffolk on March
25, 1927 as Map No. 192; and
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Mattituck, Town of Southold, County of Suffolk and State of New York, known and
designated as Lot 30 as shown on "Amended Map of Mattituck Heights, Property of Gustav Bayer at Mattituck,
Suffolk County, New York," made and surveyed by Otto W. Van Tuyl, Surveyor, Greenport, New York and filed
in the Office of the Clerk of the County of Suffolk on July 24, 1935 as Map No. 1184.
TOGETHER with all the right, title and interest of the party of the first part of, in and to Wickham Avenue and
Bayer Road abutting said premises to the center line thereof.
TOGETHER with the use in common with others of a right of way 8 feet wide to and from Wickham Avenue to
Long Creek, a branch of Mattituck Bay, to pass and repass on foot only, said right of way commencing at the
northerly junction of Middle Road and Wickham Avenue, at a concrete, monument running in a westerly
direction 8 feet;
THENCE RUNNING in a northerly direction 130 feet parallel with the boundary of Hubert W. Klein and Gustav
Bayer, to mean highwater mark of Long Creek;
THENCE RUNNING in an easterly direction 8 feet along Long Creek to land of Hubert Klein;
THENCE RUNNING in a southerly direction along the western boundary line of Hubert W. Klein 130 feet to a
concrete monument, the northerly junction of Middle Road and Wickham Avenue, the point or place of '
BEGINNING.
As to Lot 29: BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 4/7/50, recorded 4/8/50 in the Suffolk County Clerk's Office in Liber 3062 page 407;
As to Lot 30: BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 4/14/52, recorded 4/15/52 in the Suffolk County Clerk's Office in Liber 3341 page 204.
RESERVING to the party of the first part a life estate in the premises.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the parry of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties' when ever the sense of this indenture so
requires.
