HomeMy WebLinkAboutL 11972 P 540 ' Bargain.hnd Sale Deed,with Covenant against Grantor's Acts.Individual or Corporation(single sheet) THIS INDENTURE, made the 27th day of May, nineteen hundred and ninety-nine BETWEEN, POND ENTERPRISES, INC., a domestic corporation with offices at Duck Pond Road, Cutchogue, New York party of the first part, and ALEXANDROS DEMETRIADES , residing at 213 West 28th Street, New York, NY party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second party, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold at Cutchogue, County of Suffolk and State of New York: BEGINNING at a point on the easterly side of Duck Pond Lane, said point being 178.70 feet northerly from a monument set at an angle on the easterly side of Duck Pond Road, where the same turns from a northerly and southerly direction to a northeasterly and southwesterly direction, which monument is 3400 feet more or less easterly from Oregon Road; THENCE from said point of beginning, along the easterly side of Duck Pond Road, north 20 degrees 54 minutes 10 seconds west, 280.00 feet to The Long Island Sound; THENCE along the high water mark of the Long Island Sound, north 56 degrees 15 minutes 50 seconds east, 300.00 feet to lands now or formerly of McBride; THENCE along said lands, south 33 degrees 44 minutes 10 seconds east, 273.01 feet to the northerly side of a Right of Way; THENCE along said Right of Way, south 56 degrees 15 minutes 50 seconds west, 362.19 feet to the easterly side of Duck Pond Road, the point or place of BEGINNING. , BEING AND INTENDED TO BE the same premises as those conveyed to the grantor herein, by deed dated 12/10/70 and recorded 1/04 /71 in Liber 6$64 at page 276. DISTRICT SECTION BLOCK LOT IS SECT 083.00 BLK 02.00 1 LOT 001.000 TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the parry of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. ANDthe party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. ANDthe party of the first part in compliance with Section 13 of the Lien Law, covenants that the party of the first part will.receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The work "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
