BETWEEN ELLEN FLORENCE EMERY, residing at 121 Somerset Avenue, Garden City, New York 11530, as sole surviving Trustee under the Last Will and Testament of Donald C. Emery, party of the first part,and ELLEN F. Halsey, C.E. , Southampton, New York June 1919" and filed in the Office of the Clerk of Suffolk County on 10-4-19 as map No. 745, said lot also shown on "Amended Map A, Nassau Point", filed in the Office of the Clerk of Suffolk County on 8-16-22 as Map No. 156, and which lot i,s more particularly bounded and described as follows : BEGINNING at a monument on the easterly side of Nassau Point Road where the same is intersected by the division line between lots 40 and 41 as shown on the above mentioned maps; running thence North 78 degrees 36 minutes 20 seconds East along the said division line and passing through ,another monument a distance of 359 . 16 feet to the ordinary high water mark of Little Peconic Bay; running thence southerly along said ordinary high water mark of Little Peconic Bay as measured by a tie line course and distance South 9 degrees 00 minutes 40 seconds East 100 . 00 feet to the division line between lots 41 and 42 as shown on the above mentioned map; running thence South 78 degrees through another monument a distance of 360 . 00 feet to a monument on the easterly side of District: Nassau Point Road; running thence northerly along the easterly 1000 side of Nassau Point Road to the division line between lots 40 and Section: 411 as shown on the above maps and the monument set at the point or 111 place of beginning as measured by a tie line course and distance Block:13 North 8 degrees 31 minutes 40 seconds West 100 . 04 feet. Lot: 6 SAID premises being and intended to be the same premises conveyed to party of -the first part by deed dated October 30,. 1986 and recorded on November 19, 1986 in liber of deeds /0/'72- at page233 in the Suffolk County Clerk' s Office. SAID premises being known as and located at 5925 Nassau Point Road, Cutchogue, New York. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises`herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
