THIS INDENTURE, made the z'/'4~' day of September, 2008
BETWEEN
JOHN O. WINTER AND NINA Z. WINTER, his wife, residing at 4240 Palacio Drive, Sarasota, Florida
34238, party of the first part, and
JOHN O. WINTER AND NINA Z. WINTER, co-trustees, or any successor in trust, under the OXEN
BONE TRUST dated December 6, 1997 and any amendments thereto, with an address of 4240 Palacio
Drive, Sarasota, Florida 34238, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.)--Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Orient, in the Town of Southold,
County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the northerly side of North View Drive at the southwesterly corner of the
premises herein described and the southeasterly corner of land now or formerly of Summers, Atwater and
Hild; said point being also distant easterly 150.00 feet as measured along the northerly side of North View
Drive from a monument and land now or formerly of Brown's Hills Estates;
RUNNING THENCE North 20 degrees 30 minutes 00 seconds West along land now or formerly of
Summers, Atwater and Hild, 327.89 feet to the high water mark as of 6/26/03 of Long Island Sound;
THENCE easterly along said high water mark on a tie line bearing North 84 degrees 47 minutes 50
seconds East, a tie line distance of 137.71 feet to land now or formerly of Christopher and Amy Astley;
THENCE South 19 degrees 30 minutes 00 seconds East along said land now or formerly of Christopher
and Amy Astley, 315.20 feet to the northerly side of North View Drive;
THENCE South 80 degrees 00 minutes 00 seconds West along said northerly side of North View Drive,
129.50 feet to the point or place of BEGINNING.
TOGETHER WITH a right of way over said "North View Drive" from the southwesterly corner of (which
road adjoins said easterly boundary line of land of the party of the first part) the premises easterly about
540 feet to another 33 foot private road known as "Brown's Hills Road", and thence southerly over said
"Brown's Hills Road", about 2300 feet to the Main Road (Route 25).
TOGETHER WITH the right to use, in common with others, solely for recreational and not for commercial
purposes, the following described parcel of land: BEGINNING at a point on the northerly line of "North
View Drive", 240 feet westerly along said northerly line from said easterly boundary of land being the
southwesterly corner of land heretofore conveyed to Dr. Stuart Winning; from said point of beginning
running thence westerly along said northerly line of "North View Drive" on a curve to the left having a
radius of 236.52 feet, a distance of 60.0 feet; thence along other land and parallel with the westerly
boundary of said land of Winning, North 19 degrees 30 minutes West about 230 feet to the ordinary high
water mark of Long Island Sound, 60 feet more or less, to said land of Winning; thence along said land of
Winning, South 19 degrees 30 minutes East about 230 feet to the point of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
December 6, 2005, and recorded January 9, 2006 in Liber 12429 page 414.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.

above written.
