THIS INDENTURE, made the 9th day of September, Two Thousand Eight
BETWEEN
JAMES F. HAAG, JR., residing at 4725 Orchard Street, Orient, New York 11957,
party of the first part, and
RICHARD SERRA and CLARA SERRA, husband and wife, residing at 173 Duane Street, New
York, New York 10013,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate', lying and being in the Town of Southold, County of Suffolk and State of New
York, known and designated as part of Lots 7 and 8 on a certain map entitled, "Map of
Beaujolais Acres" and filed in the Office of the Clerk of the County of Suffolk on 4/14/76 as
Map No. 6373, said part of lots when taken together are bounded and described as follows:
BEGINNING at a point on the westerly side of Omhard Street where the same is intersected by
the northeast comer of land now or formerly of Casola and the southeast comer of the premises
about to be described herein, said point being also distant 617.73 feet northerly as measured
along the westerly side of Orchard Street from the comer formed by the intersection of the
northerly side of King Street with the westerly side of Orchard Street;
RUNN1NG THENCE from said point or place of beginning along land now or fom~erly of
Casola first above mentioned along land now or formerly of State of New York, South 70
degrees 13 minutes 50 seconds West, 692.77 feet to land now or formerly of Kings Bay
Properties;
RUNNING THENCE along said land, North 29 degrees 55 minutes 10 seconds West, 128.60
feet;
RUNNING THENCE North 71 degrees 09 minutes 50 seconds East, 333.43 feet;
RUNNING THENCE North 77 degrees 27 minutes 30 seconds East, 152.98 feet;
RUNNiNG THENCE North 56 degrees 08 minutes 40 seconds East, 176.81 feet to the westerly
side of Orchard Street and;
RUNNiNG THENCE along the westerly side of Orchard Street, South 41 degrees 51 minutes 10
seconds East, 156.40 feet to the point or place of BEGINNiNG.
BEING AND iNTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 11/13/1998, and recorded 12/2/1998, in the Office of the Suffolk County Clerk in
Liber 11931, Page 815.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
