THIS INDENTURE, made the 15th day of August, Two Thousand Eight
BETWEEN
MATTHEW C. WEBER, residing at 1040 Gillette Drive, Southold, New York 11971,
party of the first part, and
FREDERICK STERZENBACH and ANNA STERZENBACH, husband and wife, residing at
1230 Old Orchard Lane, East Marion, New York 11939,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at East Marion, in the Town of Southold, County of Suffolk and
State of New York, known and designated as Plot No. 23 on a certain map entitled "Map of
Marion Manor situated at East Marion, Town of Southold, Suffolk County, New York, surveyed
November 25, 1952, by Otto W. Van Tuyl and Son Licensed Surveyors in Greenport, New York,
owned and developed by Peter Blank & Son, East Williston, Long Island, New York," and filed
in the Office of the Clerk of the County of Suffolk on March 18, 1953 as Map No. 2038, which
lot is bounded and described as follows:
BEGINNING at a point on the westerly side of Gillette Drive where the same is intersected by
the division line between Lot 23 and 24 on said map;
RUNNING THENCE along the westerly side of Gillette Drive, South 25 degrees 08 minutes 50
seconds East, 100.00 feet;
THENCE South 64 degrees 51 minutes 10 seconds West, 100.00 feet;
THENCE North 25 degrees 08 minutes 50 seconds West, 100.00 feet to the abovementioned
division line;
THENCE along said division line, North 64 degrees 51 minutes 10 seconds East, 100.00 feet to
the westerly side of Gillette Drive, the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 5/17/2007, and recorded 6/12/2007, in the Office of the Suffolk County Clerk in Liber
12509, Page 122.
TOGETHER with all right, title and interest, if any, of the party of ihe first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
