HomeMy WebLinkAboutL 12400 P 549THIS INDENTURE, m~dethe 'l'~h dayofJuly, ~vothousand-fn~e SETWEEN BETTER LIVING HOMES, INC. with off=es located at 140 Oakland Avenue, Deer Park, New York 11729, party of the flint part, and JOHN BARNES and SUSAN BARNE~tesiding at 54300 Route 48, Southold, New York 11971, party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Graenpart, in the Town of Southold, County of Suffolk and State of New York known and designated as Lot No. 12 as shown on a cedain map entitled 'Map of Rockcove Estates' and filed in the Office of the CJerk of the County of Suffolk on Jun~ 1, 2001, as Map Number 10637, said lot being more particularly bounded and described as follows: BEGINNING at a stake on the southerly side of Rockcove Lane distant 121.50 feet from the extreme northeasterly end of the cuwe which connects the easterly side of Inlet Pond Road and the southerly side of Rockcove Lane; RUNNING THENCE easterly along the southerly side of Rockcove Lane the following three (3) courses and distances: 1. Easterly along an arc of curve bearing to the dght having a radius of 550.00 feet a distance of 21.56 feet; 2. Southeasterly along an arc of a curve bearing to the dght having a radius of 40.00 feet a distance of 37.42 feet; 3. Southeestedy along an arc of a curve bearing to the I~lt having a radius of 60.00 feet a distance of 71.53 feet to a stake; THENCE south 19 degrees 59 minutes 15 seconds east 221.87 feet; THENCE south 78 degrees 00 minutes 06 seconds wast 105.56 feet; THENCE north 47 degrees 41 minutes 04 seconds west 85.72 feet; THENCE north 08 degrees 37 minutes 39 seconds west 200.00 feet to the southerly side of Rockcove Lane and the point or place of BEGINNING. District: 1000 Section: 033.00 Block: 03.00 Lot: 019.012 BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by dead dated 8/5/2004 and recorded 8/9/2004 in Liber 12335, Page 927, in the Office of the Clerk of Suffolk County. THIS CONVEYANCE is being made in the regular course of business actually conducted by the party of the first part and is not a sale of substantially all of its assets. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the canter lines thereof;, TOGETHER with the appurtenances and all the estate and rights of the pan',/of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance end will hold the dght to receive such considera~k~n as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word 'party" shall be construed as if it read ~partias' whenever the sense of this indenture so requires.
