BEGINNING at a point on the northerly line of Middle Road (also known as North Road), at
the southwesterly corner of land of the party of die first part and the southeasterly corner of the
premises herein described, from said point of beginning
RUNNING THENCE along said northerly line of Middle Road, South 71 degrees 28 minutes
20 :~onds West, 15.0 feet to land now or formerly of Austin C. Butt;
THF-NCE along land last mentioned, North 15 degrees 54 minutes 00 seconds West, 150.0 feet
to land now or formerly of Edgar V. Burr;
THENCE along land last mentioned, North 71 degrees 28 minutes 20 seconds East, 16.79 feet
to thc northwesterly corner of land of the party of the first pan;
THiff-NCE along land last mentioned, South 15 degrees 14 minutes 10 seconds East, 150.0 feet
to said northerly line of Middle Road and the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first pan by
deed from Edgar V. Burr dated June 2, 1965, and recorded in the Suffolk County Clerk's
Office on June 10, 1965, in Liber 5762 page 468.
RE,SERVING, HOWEVER, a legal life estate in the above-described premises with the

THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as he may choose, to change his remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first pan's
descendants, in any degree, whether presently living or bom hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as thc party of the first pan may
direct and appoint during his lifetime by a properly written and acknowledged instrument, and
recorded prior to dr_ath, making specific reference to this power of appointment. The party of
the first pan may not appoint himself, his estate, his creditors or the creditors of his estate,
under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof'; TOGETHER
with thc appurtenances and all the estate and rights of thc party of the first par~ in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
pall:, the heirs or successors and assigns of the party of the .second part forever.

anythi~ig whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of thc first part, in compliance with Section 13 of the Lien Law, covenants that
the party of thc first part will receive the consideration for this convcyancc and will hold the
right to reccivc such consideration as a trust fund to be applied first f,or thc purpose of'paying thc
co~l of the improvcment and will apply the ,same first to the paymcnt of thc cost of the
improvement before using any par[ of'thc total of thc same for any other purpose.
The word "party" shall bc construed as if it read "parties" whenever the sens~ of this indenture so
requires.
