THIS INDENTURE, made the qday of December, 1999,
BETWEEN
HENRY ZISSEL, residing at 13435 North Canterbery Drive, Phoenix,
Arizona,
party of the first part, and
FRANCES B. ZISSEL, residing at 2345 Haywaters Road, Cutchogue,
New York,
party of the second part,
"a WITNESSETH, that the party of the first part, in consideration of TEN ($10.00)-------------------------------------

part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever, an undivided one-half interest in and to
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Nassau Point, in the Town of Southold, County of Suffolk and State of New York, known
and designated as Lot Number 378 on a certain map entitled, "Map of Section D, Nassau Point Club
Properties, Inc., situate at Nassau Point, Suffolk County, New York, surveyed by Otto W. Van Tuyle, C.E, & S.,
Greenport, NY". and filed in the Office of the Clerk of the County of Suffolk on May 7, 1926
As Map No. 806„said lot being more particularly bounded and described as follows:
BEGINNING at a point on the easterly side of Haywaters Road, where the same is intersected by the division
DIST line between Lots 378 and 379 on said map; RUNNING THENCE northerly along the easterly side of
1000 Haywaters Road, 100 feet to the division line between Lots 377 and 378 on said map, RUNNING THENCE
easterly along said division line and the division line of said Lots 378 and 393 on said map and at right angles
to the easterly side of Haywaters Road, 320 feet to the division line between Lots 378 and 387 on said map;
SEC RUNNING THENCE southerly along said division line and parallel with the easterly side of Haywaters Road,
111 100 feet to the division line between Lots 378 and 379 on said map; RUNNING THENCE westerly along said
division and again at right angles to the easterly side of Haywaters Road, 320 feet to the easterly side of
BLK Haywaters Road, at the point or place of BEGINNING.

BEING AND INTENDED TO BE the same premises conveyed to the grantor herein by deed dated November
LOT 9, 1994, recorded on November 30, 1994, in the Suffolk County Clerk's Office in Liber 11704 page 470.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other I
purpose. The word "party” shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
