THIS INDENTURE, made the 7th day of January A , nineteen hundred and seventy-two,
BETWEEN Charles S. Witherspoon and Evelyn/Witherspoon, his wife, both residing
at (no street address) Horton's Point, Southold, NY,
party of the first part, and Antoinette Heilshorn, residing at
(no street number) Orchard Road, Southold, NY,
., party of the second part,
WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consider tion
- paid by the party of the second part, does hereby grant and release unto the party of the second part, the heir
or successor and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being*xthe at Horton's Point in the Town d Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point on the southeasterly line of a 50 foot right of way, said point
being 118. 86 feet southwesterly from the northeasterly boundary of land now or
formerly of Robert L. Hyatt, measured at right angles to said boundary; running
C7 thence south 64°50'00" east, along land now or formerly of Witherspoon, 183. 04
feet to land now or formerly of Hyatt; thence south 25°10100" west, along said land
L.? M now or formerly of Hyatt, 105 feet; thence north 64°50'00" west, still along said
j� land now or formerly of Hyatt, 185 feet to a concrete monument on the southeast-
erly line of said 50 foot right of way; thence along the southeasterly line of said 50
foot right of way, the following two courses and distances: 1) north 30°10'00"
east, 22. 53 feet, and (2) north 25°10100" east, 82.56 feet to the point or place of

SUBJECT to any state of facts an accurate survey might show, and to covenants,
.` restrictions, easements, agreements, reservations, and zoning regulations of
record, if any.
TOGETHER with a right of way for purposes of ingress and egress over said 50
foot private road about 300 feet southerly from the northwesterly corner of said
premises; thence generally easterly, over a 20 foot right of way about 400 feet,
M and thence southeasterly, about 300 feet to Sound View Avenue.

CD BEING and intended to be the same premises conveyed to Charles S. and
v Evelyn A. Witherspoon, his wife, party of the first part herein by deed made by
1'79 Helen B. Simmons, dated September 21, 1961, recorded September 25, 1961, in
® liber 5053 at page 296, in the Suffolk County Clerk's office.
TOGETHER with all right,title and interest, if any, of the party of the first part of, in and to any streets and
a roads abutting the above-described premises to the center lines thereof; TOGETHER with theappurtensum
Z and all the estate and rights of the party of the first part in and to said premium; TO RAW AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successor and assigns of
the party of the second part forever.
co AND the party of the first part covenants that the party of the first part has not done or suffered anything
N whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of

eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
