THIS INDENTURE, made the ~P- day of December, 2001
BETWEEN DONALD E. WAGNER and FLORENCE M. WAGNER, his wife, both
residing at 52820 Route 48, Unit 6, P.O. Box 1840, Southold, NY 11971
party of the first part, and FLORENCE M. WAGNER, residing at 52820 Route 48, Unit 6,
P.O. Box 1840, Southold, NY 11971
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other good and
valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being more particularly described in SCHEDULE A attached hereto and made a
part hereof.
Being and intended to be the same premises conveyed to the party of the first part by deed dated
October 13, 1994 and recorded on October 20, 1994 in Liber 11699; Page 192 in the Suffolk County
Clerk's Office, State of New York.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets
and roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO
HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose. The word "party" shall be construed
as if it read "parties" when ever the sense of this indenture so requires.

ALIi that certain plot, piece or parcel of land, situate, lying and being a part of a
condominium, in the Town of Southold, Count)' ol' Suffolk and State of New York,
known and described as Home No. 6 t~)gether with a 10% undivided interest in the
common elements of the condominium hereinafter described as the same is defined in
the Declaration of Condominium hereinafter referred to.
The premises above described is a Home shown on the plans of a condominium
prepared ancl certified by Gary Cannella Associates and filed in the Office of the Clerk
of the Connty of Suffolk on the 2nd day of April, 1985, as file no. 108 as defined in
the Declaration of Condominiun't entitled Eastwind Shores Condominium made by
Solar Symmetry, Inc., under Article 9-B of the New York Real Property Law dated
March 26, 1985 and recorded in the Office of the Clerk of the County of Suffolk on

BEGINNING at a point on the southerly side of Middle Road, where it is intersected
by the easterly side of land now or formerly of l-Ierman;
RUNNING THENCE along the southerly side of Middle Road, the following two
courses arKI distances:
1. Along an arc of a curve bearing to the right with a radius of 1877.08 feet, a
distance of 149.55 feet;
2. North 65 degrees 55 minutes 50 seconds East, 9l feet to land now or formerly of
Leoanrd and others;
THENCE along land now or formerly of Leonard and others, South 45 degrees 12
minutes 10 seconds East, 518.24 feet to high water mark of Arshamomoque Pond;
THENCE along Arshamomoque Pond as it winds and tm'ns to land now or formerly of
Goetz, the following three (3) courses and distances being the tie lines along the
approximate high water mark:
1. North 84 degrees 41 minules 46 seconds West, 101.28 feet;
2. South 43 degrees 36 nfinutes 22 seconds West, 47.38 feet;
3. South 11 degrees 53 minutes 56 seconds West, 100.42 feet to land now or formerly
