southwesterly comer of land of Grcenport Realty Management Co., Inc. and runnin8 thence northwest 31
degrees 40 minutes 50 seconds 50 feet to a point;
RUNNING THENCE northeast 61 degrecs 59 minutes 10 seconds 110 feet more or less to the ordinnty
high water mark of Old Cove (an indentation of Arshamomaquc Pond);
RUNNING THENCE southesstedy along the ordinary high water mark of Old Cove, a distance of about 50
feet to a point;
RUNNING THENCE southwest 61 degrees 59 minutes 10 seconds 110 feet more or less to the point or
place of BEGINNING..
TOGETHER with the right to pass and repass for purposes ofing~s and egress over Carole Road from the
~emises to the North Road.
FOGETHER with all the right, title and interest of thc party ofthe first part in and to the lands below the
ordinary highwater mark of Old Cove adjacent to the premises.
SUBJECT, however, to ~strictions, ~-'servations, covenants and conditions of record, if any; the rights of
others to pass and repass over Carnie Road, which includes the southwesterly 20 feet of the premises, the
right, and the rights of the pa.~y of the first part or third parties to grant Io public utilities customary utility
easements therein and the following restrictions and covenants which shall at~ach to and nm with the land:
(n) that the premises shall be used only for the purpose of a dwelling for one family and such other
buildings as are appurtenant to the use and occupancy of the premises for residential purposes; (b) that no
business, indusiry, commerce, occupation or nuisance of any king shall be conducted or permitted on the
premises, and (¢) the party of the second part, his heirs, legal ~presantetives and assigns shall, at their own
proper costs, cha~ges and expense, uphold and keep in good repair that pan of Carole Road and the
bulkbending within and on their premises.
SUBJECT TO any state of facts an accurate survey might show.
THE PARTY of the second part is also given an casement to set points, lay, operate, repair and maintain
pipes, and in common with others, to exUact water for ordinary household purposes from the premises
described ns follows: beginning at the northwesterly comer of the lands above dcseribed and running
thence along thc southwesterly line of Carole Road South 31 degrees 40 minutes 50 seconds East fifty feet
to a point; thence South 61dagrees 59 minutes 10 seconds West about 37 feet to land of Wenzcl; thence
North 46 degrees 19 minutes 50 seconds West about fifty-five feet to a point; thence North 61 degrees 59
minutes 10 seconds E~t about fifty feet to the point or place of BEGINNING.

BEING AND INTENDED TO BE ~he same premises conveyed to ~he pa~y of the first part by deed
dated January 31, 1998 recorded in the Office of the Clerk of thc County of Suffolk in Liber 11878 at page

AND THE party of the tim part, in compliance with Section 13 oftbe Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration ns a Lrnst fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "pnrty' shall be construed ns if it rend "parties" whenever the
sense of this indenture so requires.
