WITNESSETH, that the party of the first part. in consideration of Ten Dollars and other valuable
consideration paid by the party of the second para, does hereby grunt and release unto the party of the s~ond part,
the heirs or successors and assigns of the party of the second party fearer,

TOGETHER with all right, title and interest, if thy. of the pan)' of the first pan in and to any st~ets and roads

estate and righm of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the pm-fy of the second part, the heirs or successors and assigns ofthe pa~y of the second part
forever.
AND the party of the first part covenants that the party of the first party has not done or suffered anything whereby
the said p~,:rnises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law. covenants that the party, of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement hefote using any pa~t of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land situate, lying and being in the ut Arshamomaque, Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the southwesterly line ora 20 foot right of way known as Carnie Road (running from the North Road
to Atshamomaque Pond) distant 150 feet, nloug said southwesterly line, from the southwesterly corner of land of Groenporl
Realty Management Co., Inc. and running thence northwest 31 degrees 40 minutes 50 seconds, 50 feet to a point; running thence
nnrthuast 61 degrees 59 minutes I0 seconds, 110 feet more or less to the ordinary high water ma~ of Old Cove (an indentation of
ArshamomaslUe Pond); running thence southeasterly along the ordinary high water mark of Old Cove, a distance of about 50 feet
to a point; running thence southxvest 61 degrees 59 minutes 10 seconds, II0 feet more or less to the point or plane of
BEGINNING.
TOGETHER WITH the right to pass and repass for purposes of ingress and egress over Carnie Road fi'om the premises to the
North Road.
TOGETHER WITH all the right, title and interest of the party of the first part in and to the lands below the high water mark of
Old Cove adjacent to the pn:mises.
SUBJECT, HOWEVER, to restrictions, reservations, covenants and conditions of record, if any; the rights of others to pass and
repass over Carnie Road, which includes the southwesterly 20 feet of the premises; thc right, and the rights of the party of the first
part or third parties to grant to public utilities customa~T utility easements therein and thc following restrictions and covenants
which shall attach to and run with the land: (a) that the premises shall be used only for the purpose nfs dwelling for one family
and such other buildings as are appurtenant to the use and occupancy of the premises for residential purposes; (bI that no
business, industry, commerce, occupatlo or nuisance of any kind shall be conducted or permitted on the premises, and (c) the
pony of the second part, his heirs, legal representatives and assigns shall, at their own proper costs, charges and expense, uphold
and keep in good repair that pan of Carnie Road, and the bulkheading within and on their premises.

THE PARTY of the second part is also given an easement to set points, lay, operate, repair and maintain pipes, and in common
with others, to extract water for ordinary household purposes from the premises described as follows: beginning at the

degrees 40 minutes 50 seconds East fi~ feet to a point: thence South 61 degrees 59 minutes 10 seconds West about fi~y feet to
land of Wenzel; thence Noah 46 degrees 19 minutes 50 seconds West about fi~ty-five f~t to a point; thence Nor~h 61 degrees 59
minutes 10 seconds East about sixty feet to the point or place of BEGINNING
RESERVING HOWEVER A LEGAL LIFE ESTATE IN AND TO THE SUBJECT PREMISES TO THE GRANTOR HEREIN
FOR THE TERM OF THE GRANTOR'S LIFE.
