THIS INDENTURE, made the
BETWEEN,
(~ay of October, in the year Two Thousand One
MARGARET O'CONNELL, residing at 53 Hardy Lane, Westbury, New York 11590, as executor of
the 10st will and testament of RENE MATOS, who died on the 1 st day of September, 2000,
the party of the first part, and
IRA STENGEL and BONNIE STENGEL, husband and wife, residing at 1'725 Chestnut Street,
Merrick, New York 11566,
party of the second part,
WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, Suffolk County, New York on December 20, 2000 (File No. 2173 P 2000) and by
virtue of the power and authority given in and by said last will and testament and/or by Article 11 of the
Estates, Powers and Trusts Law, and in consideration of TWO HUNDRED TWENTY THOUSAND
($220,000.00) DOLLARS, paid by the party of the second part, does hereby grant and release unto the
party of the second part, the distributees or successors and assigns of the party of the second part
forever,
ALL THAT CERTA1N plot, piece or parcel of land with the buildings and improvements thereon
erected, situate, lying and being at Arshamomaque, Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:-
BEGINNiNG at a point distant 250.20 feet southerly from the comer formed by the intersection of the
westerly side of Carole Road with the southerly side of Middle Road C.R. 48 (formerly North Road C.R.
27) and from said point of beginning;
RUNNiNG THENCE North 61 degrees 59 minutes 10 seconds East, 114.54 feet to the ordinary high
water mark of Old Cove;
THENCE along said ordinary high water mark in a southeasterly direction along an arc of a curve
bearing to the left suspended by a line running South 24 degrees 20 minutes 50 seconds East, a distance
of 50.0 feet;
THENCE South 61 degrees 59 minutes 10 seconds West, a distance of 108.14 feet to said westerly side
of Carole Road;
THENCE North 31 degrees 40 minutes 50 seconds West, along said westerly side of Carole Road a
distance of 50.0 feet to the point or place of BEGINNING.
TOGETHER WITH a right of way over said 20 foot private road known as Carole Road from the
southerly line of the above described premises northerly about 300 feet to said County Route 48.
SUBJECT TO the rights of others to pass and re-pass over said 20 foot right of way known as Carole
Road.
BE1NG AND iNTENDED TO BE the same premises described in deed from J. Moor-Jankowski dated
December 22, 1993, and recorded January 19, 1994, in Liber 11660 page 908. Said premises are known
and designated as District 1000, Section 052.00, Block 02.00, Lot 006.000.
TOGETHER with all right, title and interest, if any, of the party of the first part-in and to any streets
and roads abutting the above described premises to the center line thereof,
TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or has
the power to convey or dispose of, whether individually, or by virtue of said will or otherwise,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and
will apply same first to the payment of the cost of improvement before using any part of the total of the
same for any other purpose.
The word "party" shall be construed as if it reads "parties" whenever the sense of this indenture so
requires.
