THI~ INDENTURE. made the~day of September, 2004
BETWEEN
JOHN L. HURTADO, JR. AND DEBRA J. HURTADO, husband and wife, residing at 21 Astor Place,
St. James, New York 11780, party of the first bart, and
JOHN P. STANISIC, MARIA STANI$1C AND JOHN-PAUL BTANISIC, as joint tenants, residing at 19
Wedgewood Ddva, Hauppauge. New York 11788, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 001100-($10.00)--dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant end release
unto the party of the second bart, the heirs or successors and assigns of the party of the second part
forever,
ALL thai certain plot, piece or parcel of land, with the buildings end improvements thereon erected, situate,
lying an.d being in the Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as follows:
BEGINNING at a concrete monument set on the northerly line of Soundvlew Avenue at the southwest
comer of lands now or formerly of Chartes H. Zimmer and the southeast comer of property now or
formerly of Salmon Estate;
RUNNING THENCE North 3 degrees 14 minutes 40 seconds East, 271.45 feet to the ordinary high water
mark of the Long Island Sound;
THENCE along said ordinary high water mark of the Long Island Sound, South 61 degrees 31 minutes 50
seconds East, 120.21 feet to lands now or formally of Joseph Dowden;
THENCE along said last mentioned lands now or formerly of Joseph L. Dowden, South 7degrees 38
minutes 30 seconds West, 249.28 feet to the northerly line of Soundview Avenue;
THENCE along the northerly line of Soundview Avenue, North 69 degrees 13 minutes 40 seconds West,
94.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
4/9103, recorded 6/12/03 in Libar 12255 page 940, the grantors herein being the same persons as the
grantees in deed recorded in Liber 12255 page 940.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any al, =ets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the barb/of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word 'party' shall be construed aa if it read 'parties' whenever the
sense of this indenture so requires.
