HomeMy WebLinkAboutL 12157 P 239CONSULT YOUR LAVVYER BEFORE SIGNING THIS INSTRUMENT-THIS INSTRUMENT SHOULD BE USED BY LAWYERS ONLY THIS INDENTURE, made the 19th day of November, 2001, BETWEEN CHRISTOPHER FINAZZO and ANNETTE FINAZZO, husband and wife, both residing at 15 Earl Street, Westbury, New York 11590, party of the first part, and ~ CHRISTOPHER FINAZZO and ANNETTE FINAZZO, husband and wife, both residing at 15 Earl Street, Westbury, New York 11590, to an undivided one-half interest as tenants by the entirety, and DOUGLAS A. DEY and JANE M. DEY, husband and wife, both residing at 4745 North Bayview Avenue, Southold, New York 11971, to an undivided one-half interest as tenants by the entirety, party of the second part, WITNESSETH, that the party of the first part, in consideration of TWO HUNDRED EIGHTY THOUSAND DOLLARS AND OTHER GOOD AND VALUABLE CONSIDERATION paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Southold, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the southwesterly corner thereof on the northerly line of Sound View Avenue, and being the southeasterly corner of land now or formerly of "Ehrenthal"; and RUNNING THENCE north 02 degrees 10 minutes 00 seconds west along the last mentioned lands a distance of 191.29 feet to the mean high water of Long Island Sound; RUNNING THENCE north 80 degrees 34 minutes 50 seconds east on a tie line a distance of 119.51 feet and land now or formerly of "Costas"; RUNNING THENCE south 12 degrees 40 minutes 00 seconds east along the last mentioned land a distance of 198.89 feet to a point on the northerly side of Sound View Avenue; and THENCE south 83 degrees 50 minutes 00 seconds west along the northerly side of Sound View Avenue a distance of 155.17 feet to the point or place of BEGINNING. BEING AND iNTENDED TO BE the same premises described in deed dated February 10, 1999 and recorded February 19, 1999 in the Office of the Clerk of the County of Suffolk in 11946 page 622. Premises also known and designated on the Tax Map of Suffolk County as District 1000 Section 51 Block 4 and Lot 12 and by street address 20675 Sound View Avenue, Southold, New York. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the )remises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the pady of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
