This Indenture, made the 12'h day of November, Two Thousand and Four,
BETWEEN
HENRY F. SANTACROCE and BARBARA C. SANTACROCE, his wife, both
residing at 870 Richmond Road, Southold, New York 11971
party of the first part, and
THE HENRY F. SANTACROCE IRREVOCABLE TRUST, under agreement
dated, November 12, 2004, Kevin I_. Santscroee. residing at 1000 Laurel Lane. Southold,
New York 11971. as Trustee; and THE BARBARA C. SANTACROCE
IRREVOCABLE TRUST, under agreement dated, November 12, 2004, Kevin L.
Santacroce, residing at 1000 Laurel Lane, Southold, New Ymk 1197 I, as Trustee: to each
a one-half interest in the premises:
party of the second part.
WI'I'NESSF_,'fH, that the party of the first part, in consideration ofTen Dollars and other
valuable consideration paid by tile party of the second part, does hereby grant and release
unto the pan'y of the second part, the heirs or successors and assigns of the party of the
second part forever, ·
ALL that tract or parcel of land situate, lying and being at Southold, in the Town of
Southold, County of Suffolk and State of New Yolk, bounded and described as follows:
BEGINNING at an iron pipe on the .w?.sterly line of Richmond Road, 90.44 feet
northerly along said westerly line from Mill Creek Drive from said point of beginning
running along land of the party of the first part, 2 courses, as follows:
(I) South 71 degrees 41 minutes 30 seconds West a distance of 125.88 feet to an
iron pipe: thence
(2) South 50 degrees 31 minutes 00 seconds West a distance of 84.20 feet to a
monument and land of Sawicki: thence along said land of Sawicki, North 39
degrees 29 minutes 00 seconds West a distance of 139.8'/feet to an iron pipe;
thence along other land of the party of the first part, North 71 degrees 41 minutes
30 seconds East a distance of 254.95 feet to an iron pipe on said westerly line of
Richmond Road, South 18 degrees 18 minutes 30 seconds East a distance of
100.0 feet to the point or beginning, according to survey of Otto W. Van Tuyi &
Son. dated May 4, 1961.
BEING AND INTENDED TO BE the same premises conveyed to the Grantors by
Deed dated August 5, 1961 and-recorded.in the Suffolk Counly Cle. lk's Office on August
7, 1961 in Libcr 5028 page 283. ' .'
Together with all right, title and interest, if a~y. o'f th~ party of the first part in and to any
streets and roads abutting the above-described premises to the center lines thereof;
Together with thc appurtenances and all the estate and rights of the party of the first part
in and to said premises:
To have and to hold thc premises herein granted unto the party of thc second part, the
helm or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever.
except as aforesaid.
And the party of the first part. in compliance with Section 13 of thc Lien Law, covenants
that the patty of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the same for any
other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
