THIS INDENTURE, made the 23'a day of December. Two Thousand Three
BETWEEN
JOSEPH CHEREPOWICH and SUSAN G. CHEREPOWICH, his wife, residing at 6500 Main
Road, East Marion, New York { 1939, an undivided twenty-five (25%) pm'cent interest,
BARTON C. FOSTER and MARGARET G. FOSTER, his wife, residing at 200 Barbados Drive,
Merritt Island, Florida 32952, an undivided twenty.five (25%) percent interest,
SANFORD JULIAN LEE and SHIRLEY GREEN LEE, his wife, residing at I [ 7 Foxtail Drive,
Nicholaaville, Kentucky 40356, an undivided twenty-five (25%) percent interest, and
JOHN C. SKRF. ZEC and EDWINA GREEN SKREZEC, his wife, residing at 28 Sound Road,
Grecnport, New York 11944, an undivided twenty-five (25%) percent interest,
parly oflhe first part, and
CHIARLES4SANDERS, residing at 300 Johnson Court, Greenport, New York 11944,
party of thc second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by thc party of the second pm't, does hereby grant and release unto thc party
or,the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Village of Greenpon, Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a concrete monument on the northerly side of Knapp Place al the
southwesterly corner of the premises herein described and the soutfieasterly corner df land now
or formerly of Adrienm: M. Ciupryk & William lakowitz, said monument aim distant easterly
28.5.00 feet from the comer formed by the intersection of the easterly side of Main Street and
the: northerly side of Knapp Place;
RUNNING THENCE North 26 degrees 10 minutes 20 seconds West along said land now or
formerly of Adrienne M. Ciupryk & William Lakowitz, 169.87 feet to land now or formerly
of June A. & Peter W. Harris;
THENCE North 74 degrees 32 minutes 10 seconds East along said land now or formerly of
June A. & Peter W. Harris, 79.66 feet;
THENCE South 26 degrees 25 minutes 00 seconds East stiU along said last mentioned land,
16'?.46 feet to the northerly side of Kuapp Place;
THENCE South 72 deg~ 44 minutes 40 seconds West along said northerly side of Knapp
Place, 79.96 fcet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premir, es conveyed to the party of the first part by
deed from Alice R. Green, dated 9121/85, and recorded 10/7/88. in the Office of the Suffolk
County Clerk in Libor 10709, Page 360.
TOGETHER with all right, title and interest, if any, of thc pa~ of thc first part in and to any
streets and roads abutting thc above described premises to the center lines thereof; TOGETHER
with the appurtenances and all thc estate and rights of thc party of the first part in and to said
premises; TO HAVE AND TO HOLD thc premises he.in granted unto thc party of thc second
part, thc heirs or successors and assigns ofthe pa~y of the second part forevcr.
AND thc party of the first part covenants that the party of the first part has not done or suffered
anything whereby thc said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of thc first part, in compliance with Section 13 of the Lien Law, covennnts that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the puq~ose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any pert of the total of the same for any other purpose.
The word "party" shall be construed as if it reed "parties" whenever thc sense of this indenture so
