WALLACE, residing at 295 Shipyard Lane, East Marion, New York 11939; GWENDOLYN P. Orient, New York 11957 pa:ny of the second part, WITNESSETH, that thc party of thc first part, in consideration ofTen Dollars and other valuable COlaSidcration paid by the party of thc second part, docs hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of thc second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being near the Village of Greenpon, Town of Southold, County of Suffolk, anti State of New York, bounded and described as follows:- Northery by land now or formerly of Theresa Durst, 160 f~t. more or less; Easterly by Bailey Avenue, 40 feet, more or less; Southerly by land now or formerly of Otis Payne, 160 feet, more or less, which point is approximately 150 feet northerly from the intersection of Bailey Avenue and Champlain Place; and Westerly by land now or formerly of Hulse Bros., 40 feet, more or less. Said premises being Plot//44 as laid out on Map of Buckley Farm made by Otto W. Van Tuyl and dated March 20, 1924. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from George W. Hallock, Jr. dated November 4, 1959, and recorded in the Suffolk County Clerk's Office on November 9, 1959, in Liber 4722 page 06. RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and improvements thereon erected, in and to the party of the first pan. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APP. OINTMENT, exercisable as often as they may choose, to change their remainderman as · follows: TO or among any one or more members of a class consisting of the party of the first part's &'scendams, in any degree, whether presently living or bom hereafter, in such proportions and amounts, without regard to equality, outright or in trust, as the party of the first part may diirect and appoint during their lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first part may not appoint themselves, their estates, their creditors or the creditors of their estate, under any circumstances. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the he/rs or successors ~nd assigns of the party of the second part forever. AND thc party of the first part covenants that the party of thc first part has not done or suffered anything wbereby the said premises have been encumbered in any way whatever, except as afi~resaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first pan will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund Io be applied firsl for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any pan oftbe total of the same for any other purpose. The word "party" shall bo construed as if it read "parties" whenever the sense of this indenture so requires.
