ANNA CISTERJ. NO, residing at 324 Champlin Place, Grcenpon, New York 11944, as surviving
tenant by the entirety
party of the first pan, and
EDWARD M. CISTERINO, residing at 324 Champlin Place, Greenport, New York 11944
party of the second part,
WITNESSETH, that thc party of thc first part, in consideration ofTen Dollars and other valuable
consideration paid by thc party of the second part, does hereby gmat and release unto the party
ofthe second part, thc heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with thc buildings thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York,
known and designated as Lots 22 and 23 on a certain map entitled, "Map of Champlin", and
filed in the Suffolk County Clerk's Office on October 23, 1873, as Map No. 337, bounded and
described as follows:-
BEGINNING at a point on thc northerly side of Champlin Place which is distant 208.50 feet
westerly as measured along the northerly side of Champlin Place from the corner formed by
the intersection of the northerly side of C 'hamplin Place and the westerly side of Sterling Place
which point of beginning is intended to be the point of intersection of the division line between
lots 21 and 22 and the northerly side of Champlin Place;
RUNNING THENCE South 73 degrees 25 minutes West along the northerly side of Champlin
Place a distance of 76.00 feet to the land now or formerly of Stranssner;
THENCE North 23 degrees 23 minutes 40 seconds West along said last mentioned lands a
distance of 145.53 feet to land now or formerly of Rhodes;
THENCE North 73 degrees 25 minutes East along last mentioned lands, a distance of 65.77
feet to land now or formerly of Heliuski;
THENCE South 27 dcg~es 21 minutes 20 seconds East along said last mentioned lands, a
distance of 147.10. feet to the northerly side of Champlin Place and thc point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to thc party of thc first part
and Camilo Cisterino by deed from Harold P. Verity, Ruth E. Oliver, Mildt~l V. Austin, and
Dorothy Heel dated January 10, 1966, and recorded in the Suffolk County Clerk's Office on
February 7, 1966, in Liber 5907 page 116.
RESERVING, HOWEVER, a legal life estau: in ihe above-described premises with thc
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as she may choose, to change her remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, .outright or in trust, as the party of the first part may
direct and appoint during her lifetime by a properly written and acknowledged instrument, and
recorded prior to death, making specific reference to this power of appoint, mem. The party of
the first part may not appoint herself, her estate, her creditors or the creditors of her estate,
under any circumstances.
TOGETHER with all right, title and interest, if any, df the party of the first part in and to any
streets and roads abutting thc above described premises to the center lines thereof: TOGETHER
with the appurtenances and all the estate and rights of thc party of thc first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
pan, thc heirs or successors and assigns ofthc party of ibc second part forever.
AND the party ofthe first part covenants that thc party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND thc party of the first part, in compliance with Section 13 of the Lien Law, covenants that
thc party of thc first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for thc purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part ofthe total of thc same for any other purpose.
Thc word "party" shall be construed as if it read "panics" whenever thc sense of this indenture so
requires.
IN WITNESS WHEREOF, thc party of the first part has duly executed this deed the day and
year first above written.
