KUDLINSKI and JOAN~V'0LSZEWSK1, both residing at 414 Fifth Street, Greenport, NY
11944, hereinafter referred to as "Grantor," and
THOMAS M. DEWOLFE, residing at 415 Sterling Place, Greenport, NY 11944,
hereinafte:r referred to as "Grantee."
WITNESSETH
WHEREAS, the Grantor is owner of certain improved real property located at 3(11
a/k/a 411) Champlin Place, Greenport, NY, known and designated on the Suffolk County
Tax Map as District 1000 Section 034.00 Block 03.00 Lot 039.000, hereinafter referred
to as "Grantor's property;" and
WHEREAS, the Grantee is the owner of improved real property located at 415
Sterling Place, Greenport, NY, known and designated on the Suffolk County Tax Map as
District 1000 Section 034.00 Block 03.00 Lot 050.00, hereinafter referred to as
"Grantee's property;" and
WHEREAS, one of the improvements on Grantee's property is a one and one-half
story frame house, hereinafter referred to as "Grantee's house," which all parties to this
agreement acknowledge encroaches onto Grantor's property approximately .4 feet norlh
and which encroachment is shown on the annexed survey dated 9/12/2001 and prepared
by John C Ehlers Land Surveyor.
NOW THEREFORE, the parties hereto acknowledge and agree as follows:
Grantee makes no claim and will not make any claim to any portion of
Grantor's property because of the encroachment of Grantee's house omo
Grantor's property.
In consideration of the foregoing, Grantor hereby grants to Grantee the right
to continue the exclusive use of that portion of Grantee's house and that
portion of Grantor's property which is located under Grantee's house for as
long as said house remains in its present location.
Notwithstanding Grantee's right to perform ordinary maintenance and repair
to that portion of his house that encroaches on Grantor's property, in the event
Grantee's house is demolished and rebuilt, or in any way moved from its
present location, Grantee, for himself, his successors and assigns, herchy
agrees that said hou'se shall be relocated entirely within the boundaries of
Grantee's property and thereafter, all rights of Grantee in Grantor's property
shall immediately cease.
