Blk.: 4 Lot(s): 13 Quitclaim Deed This Indenture, made the 23rd day of January, Two Thousand and Two, 1 t BETWEEN qq( ~ HAZEL TUTHILL, residing at 506 Bailey Avenue, Greenport, New York 11944, as sun, iving spouse p,'nty of the first part, and ALLAN TUTHILL, residing at 295 Albo Drive, Laurel, New York 11948; and WILLIAM TUTHILL, residing at 1702 Lincoln Lane, Ro~ne, New York; as Tenants in Common, reserving to HAZEL TUTHILL residing at 506 Bailey Avenue, Greenport, New York 11944, a life estate in the premises, party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second pan, does hereby grant and release unto the party of the second pan, the heirs or successors and assigns of the party of the second part forever, in ALL that certain plot, piece or parcel of land, with buildings and improvements thereon erected, situate, lying and being in near the Village of Greenport in the Town of Southold, County of Suffolk, and State of New York, bounded and described as follows: BEGINNING at a point on the easterly line of Bailey Avenue where the same is intersected by the southerly line of land of Frederick E. and Margaret Reed Hulse; RUNNING THENCE in a southerly direction along the easterly line of Bailey Avenue a distance of fifty (50) feet; RUNNING THENCE easterly and parallel with the southerly line of land of Frederick E. and Margaret Reed Hulse to a certain right of way; RUNNING THENCE northerly along said right of way to the southerly line of land of Frederick E. Hulse and Margaret Reed Hulse; RUNNiNG THENCE westerly along the southerly line of land last mentioned to the point or place of BEGINNING. TOGETHER WITH ali the right, title and interest of the party of the first part of, in and to such portion of Bailey Avenue as adjoins said premises on the west to the center line thereof, and also TOGETHER WITH a right of way to and by the rem* of said premises as now laid out between Champlin Place and the North Road. BEING AND INTENDED TO BE the same premises conveyed to the Grantor by Deed dated November 1, 1954 and recorded in the Suffolk County Clerk's Office on November 3, 1954 in Liber 3784 page 230, the Grantor being the same person described as the Grantee in said Deed. Together with all right, title and interest, if any, of the party of the first pan in and to any streets and roads abutting the above-described premises to the center lines thereof; Together with the appurtenances and all the estate and rights of the party of the first )art in and to said premises; THE GRANTOR HEREIN RESERVES A LIFE ESTATE in the premises and further reserves the power to appoint, in whole or in pan, the property conveyed hereunder to or for the benefit of any one or more persons with the exception of the Grantor, the Grantor's estate, creditors of the Grantor or creditors of the Grantor's estate in such proportions, outright or upon such trusts, terms and conditions as the Grantor may specify by his last Will or Codicil making specific reference hereto. Failure to record notice of any such exercise of this power in the Suffolk County Clerk's Office within sixty (60) days of the Grantor's death shall be conclusively treated as a default in the exercise of power. A release of the power reserved hereunder, in whole or in part, shall be effective when recorded with the Suffolk County Clerk's Office. Any exercise or release of the foregoing power may be made by the Grantor's attorney-in-fact, acting under a durable power of attorney; To have and to hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. And the party of the first pm't covenants that the party of the first part has not done or suffered anything whereby the said prenfises have been encumbered in any way whatever, except as aforesaid. And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and will apply the same first to the payment of the cost of the improvmnent before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
