THIS INDENTURE, made the
BETWEEN
TRUMAN H. COOK, residing at 1590 Champlin Place, Greenport, New York, as surviving
tenant by the entirety
day of February, in the year Two Thousand Two
party of the first part, and
DAVID A. COOK, residing at 3050 Highland Road, Cutchogue, New York; and PETER L.
COOK, residing at (No#) Route 402, RD I Box 1352, East Stroudsberg, Pennsylvania
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being near Greenport, in the Town of Southold, County of Suffolk and State
of New York, and bounded and described as follows:-
BEGINNING at a point on the southerly line of Champlin Place, 280.0 feet westerly along said
southerly line from Manhanset Avenue, said point of beginning being the point where said
southerly line is intersected by the westerly line of a proposed highway to be known as
"Robinson Road" from said point of beginning running along said westerly line of "Robinson
Road", South 3I degrees 24 minutes 40 seconds East, 125.0 feet;
THENCE along land now or formerly of Robert H. Preston and La Grant R. Chapman, two
(2) courses as follows: (1) South 58 degrees 35 minutes 20 seconds West, 100.0 feet; thence
(2) North 31 degrees 24 minutes 40 seconds West, 125.0 feet to said southerly line of
Champlin Place;
THENCE along said southerly line of Champlin Place, North 58 degrees 35 minutes 20
seconds East, 100.0 feet to the point of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to Truman H. Cook and
Nancy W. Cook by deed from Robert H. Preston and La Grant R. Chapman dated June 21,
1957, and recorded in the Suffolk County Clerk's Office on July 8, 1957, in Liber 4325 page
201.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during his lifetime by a properly written and acknowledged instrument, and
recorded prior to death, making specific reference to this power of appointment. The party of
the first part may not appoint himself, his estate, his creditors or the creditors of his estate,
under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
