Minutes of Board of Appeals
May 9, 1957
The Board of Appeals met may 9th 1957 at the Town CIerk's office
at 7:50 pm, present; Gregonis, Rosenberg, Gillispie for the boa~d;~absent
Doyen and Bergen. Also present - R.G.Te~ryJr.,tov~n counsel and Howard
terry, Building Inspector.
Charles Gagen apoeared in connection with his development on
0akla~ Ave. Southold. ~e has agreed to enlarge all his lots to co~form
to minimum of lO0'x 125~ However he wanted the Boar~s ~eaction to sale of
two lots 90x400 which are so situated that the width cannot be ~Jxa~
enlar~fed without unnecessary hardship. The Board agreed unofficialy ~o
regsrd the sale of these lots favorably, particularly as he has agreed to
enlar~e all other lots where possible.
Ralph Glover appeared in connection with lot RO08x431/465 irregular
shape on ~.~ich there is now a house 172' fro~ front line on easterly half,
locs. ti~n near Kenny's Road, Southold. Mr Glover wondered what the Boards
reaction would be to division into 8 slightly undersize lots and erection
on each of a sm~ll cottage for rent ( cottage would be larger than 350s~ft)
Bo~.rd sugzeste~d he might look into the possibility of a tourist campat the
~¢-a~ of the p~operty, and division of remaining area into fully sized lots,
S~division of land - should be taken up with planning Board.
Mr & ~rs Ziegler appeared in connection with property they ownon
~sy Ave. East Marion. This property was discussed in May Rnd meeting,
~lans indefinite; v~ant approval of 50' lots for cottages larger that
ourist camp minimum (350soft) or they want to build some duplexes. Were
advised that subdivision o~ land is matter for planning Board. Construction
of duplexes in a residential zone would reeuire a change of zone, a matter
for the Town Board. ~
Mrs. Anderson, o~mer of a 50' ~ot with residence in Mill colony,
near Southold Tov~ Beach h~s oppertunity to purchase adJorning lot of
130'width, O~er will not sell a lesser width. ~uestionxNm~x propounded

where two or more lots were merged in event o~,~er wishes to sell a 100' lot
from ne~.~ acquisition of 130'. Board reacted favorably since
orlglnsl lot would be widened by 30' and thereby improved. In general the
Doard seemed to feel that merging of lots did not imply the original lot
held in seperate and single o~mership before enactment of ordinance had to
be increased to 100', or-that the lot increased from 50' to 80' should in
~ny ~.~ay be pen~lized in future transactions. A somewhat similar case was
discuss, ed, where both the lot width the house and adjourning lot on a
corner no~.~ vacant are undersized but both lots were in seperate ownership
before the enactment of the ordinsnce. Could the o~er of the house on t~e
