THIS INDENTURE, made the 21" day of September 1999, between Gerry L. Horton,
having an address at 0 .0. Box 1008, Mattituck, NY 11952, as Executor of the last will and
testament of Eugene Horton, late of 5275 New Suffolk Avenue, Mattituck, NY, County of
Suffolk, deceased, party of the first part, and, Aidan J. Conway, having an address at 87 Bayview
Drive, Huntington, NY 11743, party of the second part,
WITNESSETH, that the party of the first part, by virtue of the power and authority given
in and by said last will and testament, and in consideration of ninety thousand ( $90,000.00)
dollars, paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Village of Mattituck, Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNINGS at a point on the Northerly line of New Suffolk Avenue about 1200 feet Easterly
along said Northerly line from Marratooka Road, said point of beginning being the Southwesterly
corner of land now or formerly of Melot,
RUNNING THENCE North 5 degrees 17 minutes 00 seconds East 274.06 feet to said land now
or formerly of Melot;
THENCE South 79 degrees 29 minutes 50 seconds East 100.00 feet;
THENCE South 5 degrees 17 minutes 00 seconds West 265.00 feet more or less, to the Northerly
side of New Suffolk Avenue;
THENCE along the Northerly line of New Suffolk Avenue, North 82 degrees 53 minutes 50
seconds West 100 feet to the point or place of BEGINNING.
Being the same premises described in the deed to the party of the first part herein by deed from
Gertrude T. Baldwin and Eugene G. Horton, as joint tenants, with right of survivorship, dated
May 12, 1966, recorded May 13, 1966 in Liber 5956 Page 420. Said premises are known and
designated as District 1000, Section 115.00, Block 04.00 and Lot 030.00
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances, and also with all the estate which the said decedent had at
the time of the decedent's death in said premises, and also the estate therein, which the party of
the first part has or has power to covey or dispose of, whether individually, or by virtue of said

will or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any of the total of the same for any other purpose. The word"party" shall be
construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF the party of the first part has duly executed this deed on the
day and year first above written.
