WITNESSETH, that the party of the first part, inconsideration of Ten ($10.00)
dollars,
lawful money of the United States, and other good and valuable consideration paid
by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part-forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,

C.E. , filed in the Suffolk County Clerk's Office May 10th, 1940, as map number 1310
TOGETHER with all the right, title and interest of the party of the first part
Of, in and to the road in front of said premises to the center line thereof.
TOGETHER with a one-fourteenth interest of, in and to so much of lots 27 and 28
an "Map of Property of Lida Bartley, Mattituck, L.1. 11, which map was filed in the
Suffolk County Clerk's Office July 27, 1922, under number 770, as are included
in the extension of Old Salt Road from the North line of Salt Lake Village to
Salt Lake Lane (sometimes called Rodhelle Place) , subject to a right-of-way of
the owners of numbered lots on the, map of Salt Lake Village over the same and
together with a right-of-way over Salt Lake Lane (sometimes called Rochelle
Place) to Bay Avenue.
TOGETHER with 'all the right, title and interest of the party of the first part
of, in and to James Creek, the beaches adjacent thereto and the land under water,
in front of and adjoining said lot numbered 11.
TOGETHER with the right of ingress and egress between said lot and Salt Lake Lane
(sometimes called Rochelle Place) over the roads and extensions on said map, and
subject to the right of ingress and egress granted, or that may hereafter be
TAXMAP granted, to other owners of numbered lots on said map, and together with a right-
>ESIGNATION of-way over the path as shown on said map from Old Salt Road to Salt Lake Village
Beach, and to the use of said beach in common with other lot owners for bathing
and boating.

EXCEPT the rights of the U.S. Government, the State of New York, Suffolk County
and the Town of Southold and any of their departments or agencies to regulate and
control the use of the piers, bulkheads, land under water and land adjacent
thereto and except the riparian rights and easements of others over James Creek.
SUBJECT to covenants, restrictions, easements and agreements of record affecting
said premises. -
BEING, and intended to be, the same premises conveyed by Irma C. Koch to Philip
R. Marriner and Jeanne P. Marriner, his wife, the party of the first part herein,
by Deed dated July 1, 1971, recorded in the Suffolk County Clerk's Office on July
22, 1971 in Liber 6970 Page 566.
SAID premises are designated as Section 144.00, Block 05.00, Lot 028.000,
District 1000 on the Suffolk County Tax Map.

TOGETHER with all right, title and interest, if any, of the party of first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO, HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the pdrty of the first part has not done or suffered anything
whereby the said premises have been incumbered,in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The: word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
