SCHEDULE A — Description
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being at Mattituck, in the
Town of Southold, Suffolk County, New York bounded and described as
follows:
BEGINNING at a point on the southerly side of a right of way known as
Lupton Point Road, hereinafter mentioned the following three courses and
distances when measured along the southerly side of said Lupton Point Road,
from the intersection of the east side of Marratooka Lane and the south side
of said private right of way running from Marratooka Lane to Deep Hole
Creek:
1. South 71 degrees 39 minutes 20 seconds East, 250 feet; thence
2. South 73 degrees 28 minutes 50 seconds East, 468.07 feet; thence
3. North 79 degrees 45 seconds 10 seconds East, 400 feet; which point or
place of beginning also marks the northwest corner of the premises
hereby conveyed;
RUNNING 'THENCE North 79 degrees 45 minutes 10 seconds East, 100 feet
along the southerly line of said private right of way to land now or formerly
of Barbara Thompson, formerly Mason;
RUNNING THENCE along said land South 10 degrees 14 minutes 50 seconds
East, 230.88 feet to ordinary high water mark of Deep Hole Creek;
RUNNING THENCE along ordinary high water mark of said creek by a tie line
North 89 degrees 08 minutes 32 seconds West, 101.91 feet;
RUNNING THENCE North 10 degrees 14 minutes 50 seconds West, 211.25
feet to the southerly side of said private right of way at the point or place of
BEGINNING.
TOGETHER with a right of way for ingress and egress over said private right
of way, from and to Marratooka Lane.
There shall be no planting or structures constructed along the westerly
property line without the prior written consent of the grantors or the
grantor's successor in interest. The purpose of this restrictive covenant
is to preserve the waterview of Deep Hole Creek for premises to the West.
This restrictive covenant shall be binding on the grantees and their
successors in interest.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the
cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above written.
