TERMS AND CONDITIONS The Permittee Gary Guia residing at 372 North Drive Mattituck, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold aze released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this pemrit, and the said Pernuttee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Pernuttee assumes full liability with respect thereto, to the complete exclusion of the Boazd of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no umeasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstmction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to [he Town of Southold. 8. That the said Boazd will be notified by the Permittee of the completion of the work authorized. 9. Anderson 25 Oldfield Road -Conscience Point Southampton, NY 11968 RE: GARY GUJA 372 NORTH DRIVE, MATTITUCK SCTM# 106-6-29 Dear Mr. Anderson: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, August 20, 2008 regarding the above matter: WHEREAS, Philip R. Anderson on behalf of GARY GUJA applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 3, 2008, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 20, 2008, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 ~ • WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of GARY GUJA to construct a docking facility consisting of a 4'x12' ramp to a 4'x44' catwalk, elevated a minimum of 4' above grade of wetlands, a 3'x15' ramp and a 6'x20' floating dock with two (2) 8" secure piles, with the conditions that there be only two 8" secure piles, 4"x4" piles are to be used landward of the wetland vegetation and 6" piles are to be used seaward of the wetland vegetation, and as depicted on the site plan prepared by Philip R. SCTM # 1000-106-6-29 Deaz Mr. Chairman King & Members of the Southold Town Trustees: After my meeting with Chairman Mr, King at the above Guja dock site, and subsequent to my discussions with Mr. King at the site, enclosed aze 6 sets of revised dock pans that take into account all of the maritime and other concerns that Mr. King and I had discussed at the site. These dock plan changes and revisions as shown on the enclosed CAD drawings aze: 1). Relocate dock further south to allow for noninterference with neighboring dock to north (37 ft north of adjacent site's groin). (New-revised location staked with blue-ribbon stake at site). 2). Shorten planned dock by 14 ft less catwalk/dock and 3 ft less ramp. (To allow for compliance with shoreline distances in-line with other Existing docks). 3). Use 6 inch round piles seawazd of wetland vegetation. Use 4" x 4" supports landwazd and within azeas of wetland vegetation. If grate type rampfloat is requested that will also be complied with. All dock lumber and materials either untreated lumber (non-toxic) or other Inert materials such as: vinyl, fiberglass, plastic, trex. 4). Omit prior proposed sepazate tie-off pile We have placed order with the surveyor on this project, Mr. Ken Woychuk, L.S., of Mattituck, to 1 also plot these changes on the survey. I hope to have the survey copies for the upcoming Hearing of August 20, this Wednesday, But cannot guarantee at this time that we will have the revised survey that soon, but all efforts aze being made in order to have it for the Board this Wednesday, August 2Q 2008, at the Public hearing. Dear Respected Members of the Boazd of Trustees (Southold Town) With respect to the above dock permit application, at the Trustees Public Meetings of June 18, 2008, and upon review of this application, the Boazd, and the Board President Mr. King, requested that the dock location be further staked as well as the outside corners of the float be staked. This has been done by the Licensed Land Surveyor, Mr. Kenneth Woychuk, L.S., of Mattituck. Enclosed aze four photographs of the dock flagging-staking as they aze now in the field, as well as 3 copies of Mr. Woychuk's survey showing the stake locations of the dock. Please note that in review of the enclosed survey, that also shows the adjacent dock northwest, that this proposed dock of Mr. G. Guja extends no further seawazd than this adjacent dock. Also, as the boazd has recommended and requested, the `grate-type' decking will be used on the floatramp for better flowthru of precipitation and other water and wave actions. SCTM#106-6-29 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP; provided that the proposed action meets all dock standards pursuant to & 275-11 Construction and operation, specifically dock standards 1, 2 and 3. Maritime activity in Southold traditionally has been concentrated in the harbors, inlets and creeks. Developed Coast Policy #1 promotes a continuation of the traditional pattern of maritime activity, supportine the economic base, maintaining the maritime character of the Town, and avoidinE disturbance of the remainin¢ natural shoreline and water areas. It also recognized that Mattituck Inlet and Creek, identified by the state as a regional Maritime Center. DEVELOPED COAST POLICY Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The primary components of the desired development pattern are: strenethenin¢ the hamlets as centers of activity, maintaining a clear sense of separation between hamlet centers and the copntryside, encouraging water-dependent uses to concentrate in existing locations of maritime activity, enhancing stable residential areas, and preserving asriculture, open space and environmentally sensitive coastal resources. WORKING COAST POLICY Policy 10 Protect Southold's water-dependent uses and promote siting of new water- dependentuses in suitable locations. The intent of Working Coast Policv # 10 policv is to protect existing water-dependent commercial, industrial, and recreational uses and to enhance the economic viability of water-dependent uses by ensurine adeouate nravision ofinfrastructure for water-dependent uses and their efficient operation. The proposed action is consistent with LWRP Policv 10-protect Southold's water- dependant uses and further is in compliance with & 275-2 water-dependent uses. § 275-2 Definitions; word usage. WATER-DEPENDENT USES An activity which can only be conducted on, in, over or adjacent to a water body because such activity requires direct access to that water body, and which involves, as an integral part of such activity, the use of the water. The uses include, but are not limited to commercial and recreational fishing and boating facilities, finfish and steel ~h processing, fish storage and retail and wholesale fish marketing facilities, waterfront dock facilities, shipyards and boat-building facilities, navigation aides, basins and channels, industrial uses dependent upon waterborne transportation or requiring large volumes of cooling or processing water and which cannot reasonably be located or operated at an inland site, and uses which primarily provide general public access to marine or tidal waters. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as setforth in Trustee permit conditions. Furthering LWRP policv 6.3, the applicant proposes to use all untreated materials in construction and therefore is in compliance with & 275-11. § 275-11 Construction and operation standards. C. In water. The.following standards are required for all in-water operations adjacent to residential properties. Operations conducted on properties zoned MI or M2 may be given greater flexibility in these requirements given the water-dependent nature of their use. (2) Docks. [3J In order to prevent the release of metals and other contaminants into the wetlands and waters of Southold, the use of lumber treated with chromated copper arsenate (also known as "CCA"), commercial copper quat (CCQJ, creosote, yenta products or homemade wood preservatives is prohibited for use in sheathing and decking. Similarly, the use of tropical hardwoods is prohibited unless it is certified by the Forest Stewardship Council or similar organization. Materials used for structural components shall be determined at the discretion of the Trustees. The auulicant must demonstrate that the followine dock standards pursuant to & 275-11 Construction and ooeraHon standards have been met. (d) Review and approval of dock applications.
