Wiih regards to the necessary clearing to install your approved shed, clearing
landward of the 12' contour line and from the large oak tree angled back to the
western property line is permitted. Replacing cleared area with lawn landward of
the shed is also permitted. There is to be no clearing seaward of the most
northerly corner of the shed. The hay bale line is to continue along the property
to the westerly property line pdor to any construction beginning.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 1 t 1 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
September 17, 2008, and in consideration of application fee in the sum of $250.00 paid by Robert & Lisa
DeFrcse and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of
Trustees authorizes and permits the following:
Wetland Permit to install a 20'x42' in-ground swimming pool, patio and 16'x10'
shed, with the condition of a line of staked hay bales with silt fencing is installed prior
to construction, maintain the 50' Non-Disturbance Buffer on the property, and as
depicted on the site plan prepared by Randy T. Rodecker, and received on July 1, 2008.
IN W1TNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Robert & Lisa DeFrese, residing at 5223 Indian Neck Lane, Peconic, New York
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a per/od of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low. water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstraction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
author/zed.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Rodecker:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, September 17, 2008 regarding the above matter:
WHEREAS, Swim King Pools on behalf of ROBERT & LISA DEFRESE applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated July 1,2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 17, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southoid Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of ROE~ERT & LISA
DEFRESE to install a 20'x42' in-ground swimming pool, patio and 16'x10' shed, with the
condition of a line of staked hay bales with silt fencing is installed prior to construction,
maintain the 50' Non-Disturbance Buffer on the property, and as depicted on the site
plan prepared by Randy T. Rodecker, and received on July 1,2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Attached is a Letter of Non-Jurisdiction which was sent to the applicant in 1996. It states
that the property lying landward of the 10 foot elevation contour is outside the jurisdiction
of the Tidal Wetlands Act. Since the newly proposed swimming pool and patio are to be
situated landward of that contour, these structures would also lie outside the jurisdiction
of the Tidal Wetlands Act.
if any alteration to the plan were to be made so that any part of the pool and patio were
to be situated seaward of the 10 foot contour, a permit would be required. It is also the
responsibility of the applicant to ensure that no disturbance or sedimentation of the land
within the Tidal Wetlands jurisdiction occurs. To this end it is recommended that erosion
control methods be employed, such as establishing an adequate work are and placing
hay bales or a silt screen between the work area and the area seaward of the 10 foot
contour.

Based on the information you have submitted, the New York State
Department of Environmental Conservation has determined that:
the property landward of the 10' contour elevation on a natural,
gradual slope as shown on the survey prepared by Peconic Surveyors,
dated July 31, 1996 and last revised October 7, 1996 is beyond the
jurisdiction of Article 15 Tidal Wetlands.
Therefore, in accordance with the current Tidal Wetlands Land Use
Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of
the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of
the responsibility of obtaining any necessary permits or approvals
from other agencies.

swimming pool, patio and 16'X 10' shed. Located: 5223 Indian Neck Lane, Peconic. SCTM#98-1-1.4
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and
the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to me, it is our recommendation that
the proposed action (POOL) is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the
LWRP; provided that the proposed pool and related structures are placed at a minimum setback orS0 feet from the
wetland boundary pursuant to § 275-3.
Policy 6. Protect and restore the quality and function ofthe Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requiremenls of the Southold Town Board of Trustees laws and regulations for
all Andros Patent and other lands under their jurisdiction

LWRP CONSISTENCY ASSESSMENT FORM

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfxont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
