KENNELLY, late of Nassau County, New York, deceased, party of the first part, and MARY RITA KENNELLY, residing at 104 Chase Road, Manhasset, New York 11030 and KATHLEEN FELDON, residing at 146 Emory Road, Mineola, New York 11501, as Co-Trustees of Trust created under Article THIRD of the Last Will and Testament of THOMAS F. KENNELLY party of the second part, WITNESSETH, that the party of the first part, by virtue of the power and authority given in an by said last will and testament, and in consideration of Ten Dollars, paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Laurel, Town of Southold, Suffolk County, New York, and described as follows: BEGINNING at a point on the southeasterly line of Peconic Bay Boulevard where said southeasterly line is intersected by the easterly line of land now or formerly of Eric and Maryann Alexander, said point of beginning being more particularly described as situate at a point which bears north 33 degrees 43 minutes 55 seconds east a distance of 784.95 feet from the intersection of the northerly line of Peconic Bay Boulevard and the easterly line of Delmar Drive, and RUNNING THENCE from said point of beginning the following two (2) courses and distances along the southeasterly line of Peconic Bay Boulevard: 1. North 30 degrees 07 minutes 00 seconds east 28.62 feet to a monument; 2. North 40 degrees 59 minutes 20 seconds east 88.93 feet to a monument and land now or formerly of Joseph M. and Lauretta A. Connelly, RUNNING THENCE south 42 degrees 19 minutes 50 seconds east along land now or formerly of Joseph M. and Lauretta A. Connelly 67.40 feet to a monument and land now or formerly of McGowan; RUNNING THENCE south 39 degrees 45 minutes 10 seconds west along the land now or formerly of McGowan 148.95 feet to a point and land now or formerly of Eric and Maryann Alexander; Cnsr. i000 RUNNING THENCE north 1? degrees 29 minutes 50 seconds west along the land now or formerly Bik. oa o0 of Eric and Maryann Alexander 75.96 feet to the southeasterly line of Peconic Bay Boulevard and the Lnt ol3.00o point or place of BEGINNING. BEING THE SAME PREMISES conveyed to the party of the first part by deed dated August 24, 1998, recorded in the Office of the Clerk of the County of Suffolk on September 9, 1998 at Liber 11315, page 956. SAID PREMISES being known and designated as Section 128.00, Block 04.00, Lot 013.000 on the Suffolk County Land and Tax Map, and by the street address 4600 Peconic Bay Boulevard, Laurel, New York 11948. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate which the said decedent had at the time of decent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individually, or by virtue of said will or otherwise, TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part: covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
