BARGAIN & SALE DEED
THIS INDENTURE, made this 23rd day of September, nineteen hundred and ninety-nine
BETWEEN ZOUMAS CONTRACTING CORPORATION, having its principal place of
business at 18 Deerfield Drive, Wading River,New York H792
Party of the fust part, and

WILLIAM A. MULRAIIV and CATHERINE SMITH-MULRAIN, his wife, both residing at
1520 Bray Avenue, Laurel, New York 11948
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release unto
the part of the second part, the heirs or successors and assigns of the party of the second part
forever.
ALL, that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Cutchogue, Town of Southold, County of Suffolk and State
of New York, known and designated as Lot # 4 as shown on a certain map entitled, "Map of
Woodbine Manor" and filed in the Suffolk County Clerks Office on December 15, 1986 as Map
# 8239 and being more particularly bounded and described as follows:
BEGINNING at a point on the northeasterly side of Duck Pond Road at the extreme westerly
end of the curve connecting the northeasterly side of Duck Pond Road with the northwesterly
side of Olivia Lane; RUNNING THENCE along the northeasterly side of Duck Pond Road
North 39 degrees 00 minutes seconds West 135.55 feet to the division line between lots 3 and 4
on said map; RUNNING THENCE along said division line North 51 degrees 00 minutes 00
seconds East 250.00 feet; RUNNING THENCE South 39 degrees 00 minutes 00 seconds East
160.55 feet to the northeasterly side of Olivia Lane; RUNNING THENCE along the
northeasterly side of Olivia Lane and the following (2) courses and distances: South 51 degrees
00 minutes 00 seconds West 225.00 feet; Westerly along the arc of a curve bearing to the right
having a radius of 25.00 feet a distance of 39.27 feet to the northeasterly side of Duck Pond
Road at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated August 1997, acknowledged 8/26/97 and recorded 9/23/97 in Liber 11853 cp 364.
The above conveyance has been made with the unanimous consent in writing of all the
stockholders of the party of the first part.
TOGETHER with all right, title and interest, if any, of the party of the fust part in and to any
streets and roads abutting the above described premises to the center lines thereof: TOGETHER
with the appurtenances and all the estate and rights of the party of the fust part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the fust part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it to read "parties" whenever the sense of this
indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
